PUBLIC HEARING NOTICE
For the Repeal of the Rules and Regulations
Governing Recreation Child Care Programs
And to Adopt Proposed City and County of Honolulu
Administrative Rules, Title 19, Chapter 14,
Recreation Child Care Programs
Notice is hereby given of proposed rule repeal, rulemaking and public hearing by the Department of Parks and Recreation, City and County of Honolulu, to consider the repeal of the Rules and Regulations Governing Recreation Child Care Programs (“current rules”) and the adoption of proposed City and County of Honolulu Administrative Rules, Title 19, Chapter 14, governing recreation child care programs (“proposed rules”).
The Department of Parks and Recreation proposes to repeal the current rules regulating recreation child care programs for the purpose of converting the current rules to the Hawaii administrative rules form and adopting new rules governing recreation child care programs. The proposed rules add new definitions and clarify existing definitions, establish minimum staffing requirements, procedures governing administration requirements, registration, application process, attendance, withdrawal, dismissal, safety and health of participants, fees and procedures for waivers and refunds.
The proposed new rules are summarized as follows:
§19-14-3: Definitions have been added and existing definitions have been amended.
§19-14-4: Adds a severability provision.
§19-14-5: Establishes ages of child in care for recreation child care programs.
§19-14-6: Records policy.
§19-14-7: Provisions governing the disclosure of information about a child in a recreation child care program.
§19-14-8: Goals of the recreation child care programs.
§19-14-9: Procedures governing requests for reasonable program modifications to accommodate children with disabilities.
§19-14-10: Programs operated on behalf of the Department shall comply with department rules.
§19-14-11: Notification provisions.
§19-14-12: Provisions governing program registration and the content of the registration form.
§19-14-13: Standards for registration priority.
§19-14-14: Provisions governing registration wait lists and notification procedures.
§19-14-15: Field trips procedures; notification that parents or guardians are responsible for all field trip costs; and potential program suspension or dismissal for failure to pay field trip costs.
§19-14-16: Voluntary attendance and children failing to report shall be deemed absent with parental or guardian consent.
§19-14-17: General release provisions.
§19-14-18: Provisions governing restricted pick-up.
§19-14-19: Provisions governing pick up and sign-out of children.
§19-14-20: The Honolulu Police Department shall be contacted if a child is not picked up within one hour after close of program day.
§19-14-21, Provisions governing the withdrawal, dismissal or suspension of a
22 and 23: child from a recreational child care program.
§19-14-24: Minimum staffing requirements.
§19-14-25: Staff training and character requirements.
§19-14-26: Fees for recreational child care programs.
§19-14-27: Provisions governing waiver of program fees.
§19-14-28: Provisions governing refund of program fees.
§19-14-29: Transferring of registration fees.
§19-14-30: Payment requirements.
§19-14-31: Provisions governing sick or ill children.
§19-14-32, Provisions governing medical requests, allergies, and procedures
33, and 34: governing medical emergencies.
§19-14-35: Provisions governing closure of program sites due to unforeseen emergencies.
§19-14-36: Authority to remove unregistered or uninvited persons from program sites.
§19-14-37: Requirement that parents or guardians must provide medical and health insurance for children participating in recreation child care programs.
A public hearing will be held on June 10, 2014, in the Mission Memorial Building, 550 South King Street, 1st floor conference room, starting at 1:00 p.m. and ending at 4:00 p.m.
All interested persons are urged to attend the public hearing and present data, views, or arguments in the time limit provided, for consideration by the Department of Parks and Recreation. Persons unable to attend or wishing to present additional comments may mail written testimony to the Department of Parks and Recreation, Executive Services Division, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707, no later than June 17, 2014.
Interested persons may review the current rules to be repealed and proposed rules starting today and ending five days prior to the day of the public hearing during the hours of 7:45 a.m. to 4:30 p.m. at the Department of Parks and Recreation, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707.
A copy of the rules to be repealed and proposed rules will be mailed to any person who submits a written request to the above address and pays the required fee of $11.56 for the cost of duplicating the documents and postage. A complete set of the current rules to be repealed and proposed rules is also available, free of charge, on the City’s internet web site: http://www. Honolulu.gov/parks/.
