PUBLIC HEARING NOTICE
For the Proposed Amendment of the
Rules Governing Dogs in Public Parks
Title 19, Chapter 5

Notice is hereby given of proposed rule amendments and a public hearing by the Department of Parks and Recreation, City and County of Honolulu, to consider amendments to the Rules Governing Dogs in Public Parks (“rules”).

The Department of Parks and Recreation proposes to amend the current rules governing dogs to include the following proposed amendments:

Amend Section 19-5-3 “Definitions” to provide definitions for the terms “dangerous dog” and “provocation;”
Amend Section 19-5-5(b) to clarify that a dog in a leash park must be on a leash, cord, chain or other means of physical restraint not more than eight feet in length and under the physical restrictive control of its handler at all times;
Amend Section 19-5-5(b) to clarify that any dog in a leash park shall wear a valid current “Hawaii” dog license tag attached to the dog’s collar;
Amend Section 19-5-7(b)(2) to clarify that a dog in an off leash park must be on a leash, cord, chain or other means of physical restraint not more than eight feet in length and under the physical restrictive control of its handler at all times when entering or exiting the park;
Amend Section 19-5-7(b) (8) to clarify that any dog in an off-leash park shall wear avalid current “Hawaii” dog license tag attached to the dog’s collar;
Amend Section 19-5-7(b) to add the provision that the handler must remain in the off leash park and keep the dog in view at all times and that no dog shall be left unattended in an off leash park;
Amend Section 19-5-7(b) to add the provision prohibiting a dangerous dog in an off-leash park; and
Amend Sections 19-5-5(b) and 19-5-7(b) to correct grammatical, technical, nonsubstantive and conforming amendments.

A public hearing will be held on November 20, 2013 in the Hearing Room of the Mission Memorial at 550 S. King, starting at 3:00 pm and ending at 5:00 pm.

All interested persons are urged to attend the public hearing and present data, views, or arguments in the time limit provided, for consideration by the Department of Parks and Recreation. Persons unable to attend or wishing to present additional comments may mail written testimony to the Department of Parks and Recreation, Executive Services Division, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707, no later than November 27, 2013.

Interested persons may review the proposed rule amendments starting today and ending five days prior to the day of the public hearing during the hours of 7:45 a.m. to 4:30 p.m. at the Department of Parks and Recreation, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707.

A copy of the proposed rule amendments will be mailed to any person who submits a written request to the above address and pays the required fee of $2.71 for the cost of duplicating the documents and postage. A complete set of the proposed rule amendment is also available, free of charge, on the City’s internet web site: http//www.honolulu.gov/parks/.
