NOTICE OF PUBLIC HEARINGS

Pursuant to chapters 91, 92, and 321-11, Hawaii Revised Statutes, notice is hereby given that the Department of Health of the State of Hawaii will hold public hearings on the repeal of Hawaii Administrative Rules, Title 11, Chapter 12 (“HAR chapter 11-12”), entitled “Food Establishment Sanitation,” and adoption of proposed Hawaii Administrative Rules, Title 11, Chapter 50 (“HAR chapter 11-50”), entitled “Food Safety Code”.
The proposed rules update provisions of HAR chapter 11-12 dealing with food establishment sanitation by clarifying certain definitions, requirements, and permitting procedures and establishing new requirements for food establishments. The proposed rules also adopts the 2009 FDA Model Food Code almost in its entirety, changes the permit renewal period from two years to one year, establishes a new permit fee system, and allows the Director of Health to placard the food establishment with the inspection results immediately upon completion of the inspection.

All interested persons may submit testimony orally or in writing to the presiding hearings officer at the public hearing. Written testimony will also be accepted until 4:30 p.m. on December 13, 2013 at: Sanitation Branch, 591 Ala Moana Boulevard, Honolulu, Hawaii, 96813.
A copy of the proposed rules to be adopted, HAR chapter 11-50, and/or the proposed rules to be repealed, HAR chapter 11-12, will be mailed to any person who requests a copy and pays in advance for the copy and postage. A copy of the proposed rules will be mailed at no cost to any existing HAR chapter 11-12 Food Establishment Sanitation permit holder who requests a copy.
