NOTICE IS HEREBY GIVEN, of a public hearing to be held by the County of Kauai Planning Commission at the Lihue Civic Center, Mo`ikeha Building, Meeting Room 2A-2B, 4444 Rice Street, Lihue, Kauai on Tuesday, July 14, 2009, at 1:30 p.m., or soon thereafter to consider under the Special Management Area Rules and Regulations of the County of Kauai, the following:
1. Special Management Area Use Permit SMA(U)-2009-4 to reconstruct the Kamalani Pavilion within the Lydgate Park complex, which was destroyed by fire in 2007, Wailua, Kauai, Tax Map Key 3-9-2: 34, which contains an overall area of 4.196 acres.
2. Second Amendment to Special Management Area Use Permit SMA(U)-2005-8 in order to allow revisions to the master plan for the Kauai Lagoons Resort development to provide, within the previously approved 750-unit density cap, approx. 387 resort residential units comprised of 372 condominium/time share units, revised large lot supervision and boundary adjustments to accommodate 15 single-family residential lots, and support facilities, including a central operations building with a marketplace/cafe; a temporary central operations facility; administrative office facilities; a temporary sales facility and model units; a marketplace express and grill/kitchen; a kids club; a fitness center; a resales center; a landscape maintenance facility with a private potable domestic/fire water booster pump station; a private underground sewer pump station; swimming pools with a flowrider water amenity; two (2) pool bars with associated restrooms and storage rooms; three (3) greeter stations; two (2) electrical/mechanical facilities; drainage improvements, including three (3) grassed detention basins and channelization of a portion of an existing western drainage channel; and approx. 1,098 parking stalls. The project improvements are located on property situated in Nawiliwili-Lihue within the Kauai Lagoons Resort Master Development Plan area northeast-east of the existing Kauai Marriott Resort and Beach Club, further identified as Tax Map Keys: 3-5-01: 27 (por.), 169, 171 (por.), 172 (por.), 175 and 176, and affecting a project area of approx. 53.2 acres. The withdrawal of Special Permit SP-2008-4 cancels the development of a proposed tennis court complex in the State Agricultural Land Use District specifically affects a portion of the Kauai Lagoons Resort’s Mokihana Golf Course, further identified as Tax Map Keys: 3-5-01: 27 (por.) and 168 (por.) and containing a project area of approx. 1.0 acre.
All interested persons may present testimony for or against any application as public witnesses. Such testimony should be made in writing and presented to the Commission prior to the public hearing. Late written testimony may be submitted up to seven (7) days after the close of the public hearing in cases where the Commission does not take action on the same day the hearing was held.
Any party may be represented by counsel if he or she so desires. In addition, individuals may appear on their own behalf, a member of a partnership may represent the partnership, and an officer or authorized employee of a corporation or trust or association may represent the corporation, trust or association.
Petitions for intervenor status must be submitted to the Commission and the applicant at least seven (7) days prior to the date of the hearing advertised herein and shall be in conformance with Chapter 4 of the Rules of Practice and Procedure of the Planning Commission.
Proposed plans and the Rules of Practice and Procedure of the Planning Commission are available for inspection at the Planning Department which is located at 4444 Rice Street, Lihue, Kauai.
