NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on April 13, 2009, a public hearing as required by Section 147(f) of the Internal Revenue Code of 1986 will be held with respect to the proposed issuance by the City and County of Honolulu, Hawaii (the “City and County”) of its General Obligation Bonds or Commercial Paper Notes, issued pursuant to a plan of financing from time to time in one or more series in a maximum aggregate principal amount outstanding at any time not to exceed $450,000,000 (the “Obligations”). A portion of the proceeds of the Obligations in an amount not to exceed $450,000,000 is expected to be used to finance the construction, installation, acquisition and/or replacement of certain solid waste disposal, electrical production and pollution control equipment, including a new boiler and new scrubbers, at a waste-to-energy facility which produces electricity that is sold to the local electric company, known as the H-Power waste disposal facility (the “Facility”). The Facility is located at 91-174 Hanua, Kapolei, HI, 96707, and is owned by the City and County.
The hearing will commence at 9 a.m. local time, or as soon thereafter as the matter can be heard and will be held in Conference Room C, ground floor, Kapolei Hale, 1000 Uluohia St., Kapolei, Hawaii 96707. Interested persons wishing to express their views on the issuance of the Obligations or on the nature and location of the facilities proposed to be financed or refinanced may attend the public hearing or, prior to the time of the hearing, submit written comments to the attention of Tim Houghton, Executive Assistant, Department of Environmental Services, City and County of Honolulu, Hawaii, 1000 Uluohia St., Suite 308, Kapolei, Hawaii 96707.
