NOTICE OF PUBLIC HEARING
HANA ADVISORY COMMITTEE TO THE
MAUI PLANNING COMMISSION

The Hana Advisory Committee to the Maui Planning Commission for the County of Maui hereby gives notice that it will conduct a public hearing on Monday, December 15, 2008 commencing at 4:00 p.m., or as soon thereafter as is practicable, at Helene Hall, Hana, Island of Maui on the following:

SPECIAL MANAGEMENT AREA USE PERMIT AND SHORELINE SETBACK VARIANCE

1. MR. JAMES H. BARRY of SEA ENGINEERING, INC. on behalf of the STATE DEPARTMENT OF LAND AND NATURAL RESOURCES, DIVISION OF BOATING AND OCEAN RECREATION requesting a Special Management Area Use Permit and a Shoreline Setback Variance for the improvements to the rock revetment and boat loading docks at the Hana Wharf, TMK: 1- 4-004: 036, Hana, Island of Maui. (SM1 2007/0007) (SSV 2007/0003)

The subject hearing will be conducted in accordance with the Hawaii Revised Statutes, the Maui County Code, and the Rules of the Maui Planning Commission. Information pertaining to the subject application may be obtained from the Maui County Department of Planning, 250 South High Street, Wailuku, Maui.

Petitions to intervene shall be in conformity with Section 12-201-20 of the Rules of Practice and Procedure for the Maui Planning Commission and shall be filed with the commission and served upon the applicant no less than ten (10) days before the first public hearing date. Filing of all documents to the commission is c/o the Maui Planning Department, 250 South High Street, Wailuku, Maui, Hawaii 96793. The deadline for the filing of a timely Petition to Intervene is December 1, 2008 at 4:30 p.m.

All testimony regarding the subject application may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Planning Department or may be presented at the time of the hearing.
