NOTICE OF PUBLIC HEARING
DEPARTMENT OF AGRICULTURE
PROPOSED REPEAL AND ADOPTION OF ADMINISTRATIVE RULES RELATING TO VOLUNTARY REGISTRATION OF SERVICE PERSONS AND SCHEDULE AND FEES FOR LICENSING DEVICES SUSCEPTIBLE OF COMMERCIAL USAGE, AND MEASURING DEVICES AND MEASUREMENT STANDARDS FOR TESTING OR CERTIFICATION

Notice is hereby given that the Department of Agriculture, pursuant to Chapter 91 and Section 486-7, Hawaii Revised Statutes, will hold a public hearing as follows:

The purpose of the public hearing is to receive testimony related to the proposed repeal and adoption of Hawaii Administrative Rules Title 4 Subtitle 7 Chapter 87, entitled “Voluntary Registration of Service Persons” and Subtitle 7 Chapter 96, entitled “Schedule and Fees for Licensing Devices Susceptible of Commercial Usage, and Measuring Devices and Measurement Standards for Testing or Certification,” summarized below:
Chapter 4-87 describes the requirements and qualifications of registered service persons, including the registration fee, necessary reports, and correct measurement standards and measures. Chapter 4-87 also describes what is a violation, the privileges of a registered service person, and what action will result in the revocation of the certificate of registration.
Chapter 4-96 is a schedule of fees for licensing those devices susceptible of commercial usage and measuring devices and measurement standards for testing or certification. This chapter describes commercial usage, annual license renewal, who is responsible for submitting an annual fee, schedule of fees associated with the certification of measurement standards, fees associated with special tests, the charge for a returned check, and any exemptions.
The proposed rules with amendments will be available for review in person at the following Department of Agriculture offices during normal business hours of 7:45 a.m. to 4:30 p.m., Monday to Friday from September 29, 2008 to October 13, 2008:

Copies of the proposed rules with amendments may also be obtained at the above offices by paying a fee charge for photocopying or sent by mail upon receipt of a fee charge for photocopying and postage. Copies may also be reviewed or downloaded at the Department of Agriculture website at http://www.hawaiiag.org/hdoa/publicnotice.htm.
All interested persons may attend the public hearing and submit comments orally or in writing. Those persons desiring to submit written testimony prior to the hearing may do so via postal mail to the Department of Agriculture’s Chairperson’s Office at 1428 S. King Street, Honolulu, HI 96814-2512, or via fax to the Department of Agriculture Chairperson at (808) 973-9613 or via e-mail at HDOA.BOARDTESTIMONY@HAWAII.GOV. Please include the word “testimony” and the subject matter when submitting testimony by e-mail. Those persons desiring to present oral testimony at the hearing are asked to submit 5 written copies of the testimony to staff prior to the convening of the hearing, if possible.
