NOTICE OF PUBLIC HEARING
BOTTLE BILL RULE CHANGES TO CREATE A FIELD CITATION PROGRAM
STATE OF HAWAII, DEPARTMENT OF HEALTH
SOLID AND HAZARDOUS WASTE BRANCH

Under Sections 91-3 and 342G-109, Hawaii Revised Statutes (HRS), the State of Hawaii, Department of Health (DOH) will hold a public hearing to consider proposed amendments to Chapter 11-282, Hawaii Administrative Rules (HAR), Deposit Beverage Container Recycling.
The amendment proposal allows DOH to issue field citations for easily verifiable violations. This change is expected to increase compliance with the deposit beverage container (DBC) recycling laws by redemption centers, dealers, and distributors, which will lead to fewer violations of the law, fewer complaints and minimize opportunities for fraud.
A Public Hearing will be held on March 4, 2008 at 6 p.m. at the following locations through videoconferencing:

All interested persons are invited to testify on the proposed amendments orally or in writing at the hearing, or via written correspondence to the Departments Solid and Hazardous Waste Branch (SHWB) at the address below prior to the hearing. Those testifying should limit their oral and written submissions to discussions of the proposed amendments and should not discuss the benefits or disadvantages of the underlying program as that is not the subject matter of the hearing. DOH will consider all written and oral submissions on the proposed amendments to the DBC rules, DOH strongly encourages those testifying to submit six (6) copies of their testimony to SHWB at the addresses below or send e-mail to DOH via mayumi.bendiner@doh.hawaii.gov by 4:30 p.m., March 4, 2008.
The proposed rules may be reviewed in person for free at the SHWB and District Health Offices between 8:00 a.m. and 4:30 p.m., Monday through Friday, excluding holidays. The proposed rules may be viewed and downloaded for free from the Departments website:

The Department intends to decide on the proposed rules at the end of the hearing or as soon as practicable thereafter. If the Department does not make its decision immediately after the hearing and takes the testimony on the proposed rules under advisement, it will announce the date when it intends to make its decision.
