NOTICE TO BIDDERS

SEALED BIDS will be received up to and opened at 2:00 P.M., Hawaii Standard Time, on April 24, 2007, in the Office of the Division of Purchasing, Department of Finance, 4444 Rice Street, Room 303, Lihu‘e, Kaua‘i, Hawai‘i, 96766, for the Furnishing and Paying for all materials, labor, transportation, tools, equipment, machinery and services necessary to construct in place complete KAUA‘I ADA PRIORITY 2, PHASE A AND PHASE B CURB RAMPS AND SIDEWALKS AT VARIOUS LOCATIONS ON KAUAI, FEDERAL-AID PROJECT NO. CMAQ-0700(52), DISTRICTS OF HANALEI, KAWAIHAU, KOLOA, LIHU‘E AND WAIMEA, ISLAND OF KAUA‘I.
The project involves removing and disposing of existing curb, gutter, concrete sidewalk, curb ramps, pavement markings and striping; installing concrete curbs, curb and gutter, curb ramps, and concrete and asphalt concrete sidewalks and asphalt concrete pavement; adjusting utility boxes, relocating utility boxes and poles, and installing pavement marking, striping and signing.
BIDDERS ARE HEREBY NOTIFIED THAT EVIDENCE OF THE AUTHORITY OF THE PERSON(S) SIGNING THE BID DOCUMENT IS REQUIRED TO BE INCLUDED WITH THE BID DOCUMENTS. FAILURE TO COMPLY WITH THIS REQUIREMENT WILL BE CAUSE FOR REJECTION OF THE BID AS BEING NON-RESPONSIVE OR NON-RESPONSIBLE.
The successful bidder shall be required to submit to the County of Kaua‘i, a tax clearance from the State Department of Taxation and the U.S. Internal Revenue Service, a Certificate of Good Standing from the State Department of Commerce, and a Certificate of Compliance from the State Department of Labor and Industrial Relations as a prerequisite to entering into a contract.
Bid documents may be obtained from said office upon application and deposit of ONE HUNDRED FIFTY AND NO/100 DOLLARS ($150.00) in cash, cashier’s check or certified check made payable to the “Director of Finance, County of Kaua‘i”. The deposit shall be refunded upon the return of the specifications in good condition provided that they are returned within thirty (30) calendar days after the date designated above for the opening of bids. No refund shall be made after the expiration of such period.
The Director of Finance reserves the right to reject any or all bids, in whole or in part, if deemed to be in the best interest of the County.
All prospective bidders shall have a Hawaii State General Engineering Contractor’s license type “A” to be qualified to submit a bid.
The U.S. Department of Transportation Regulation entitled “Nondiscrimination in Federally-Assisted Programs of the U.S. Department of Transportation,” Title 49, Code of Federal Regulations (CFR), Part 21 is applicable to this project. Bidders are hereby notified that the County will affirmatively ensure that the contract entered into pursuant to this advertisement will be awarded to the lowest responsible bidder without discrimination on the grounds of race, color, national origin and sex (as directed by 23 CFR Part 200).
The Equal Employment Opportunity Regulations of the Secretary of Labor implementing Executive Order 11246 shall be complied with on this project.
The U.S. Department of Transportation Regulations entitled “Participation by Disadvantaged Business Enterprise in Department of Transportation Programs”, Title 49, Code of Federal Regulations, Part 26 is applicable to this project. Bidders are hereby notified that the Department of Transportation will strictly enforce full compliance with all of the requirements of the Disadvantaged Business Enterprise (DBE) program with respect to this project.
Bidders are directed to read and be familiar with the General Information Regarding Disadvantaged Business Enterprises (DBEs) and Regulatory Requirements for Federal-Aid Projects regarding Disadvantaged Business Enterprise (DBE), which establishes the program requirements pursuant to Title 49 Code of Federal Regulations Part 26 and, particularly, the requirements of certification, method of award, and evidence of good faith.
A written Notice of Intent To Bid must be submitted by all prospective bidders. Such written notice must be received by the Director of Finance no later than April 11, 2007, 4:00 P.M., HST, ten (10) calendar days prior to the bid opening date. Risk of late delivery by mail shall lie with the bidder.
A non-mandatory pre-bid conference is scheduled for March 29, 2007 at 10:00 am HST, 4444 Rice Street, Lihue, HI., Moikeha Building, Meeting Rooms 2A and 2B. All interested parties, contractors, subcontractors, and respective union representatives are invited to attend.
