STATE OF HAWAII
NOTICE OF INTENTION TO DISQUALIFY THE GREEN PARTY OF HAWAII
AS A POLITICAL PARTY
Pursuant to the requirements of Sections 11-61 and 11-65, Hawaii Revised Statutes, I, DWAYNE D. YOSHINA, as the chief election officer of the State of Hawaii, hereby provides this notice of intention to disqualify the Green Party of Hawaii in the State of Hawaii. The Green Party of Hawaii is being disqualified as a political party because it has failed to satisfy the requirements under Section 11-61(b), Hawaii Revised Statutes, by not obtaining the required number of votes in the 2006 General Election:
1. The Green Party had a candidate running for election in the 2006 general election for Governor;
2. The Green Party failed to receive at least ten percent of all votes cast for (a) for any of the offices voted upon by all voters in the State and (b) failed to receive at least ten percent of all votes cast in at least fifty percent of the congressional districts;
3. The Green Party failed to receive at least four percent of all the votes cast for all the offices of state senator statewide;
4. The Green Party failed to receive at least four percent of all the votes cast for all the offices of state representative statewide; and
5. The Green Party failed to receive at least two percent of all the votes cast for all the offices of state senate and all the offices of state representative combined statewide.
If an officer of the Green Party of Hawaii whose name is on file with the Office of Elections desires a hearing on the notice of intention to disqualify, that officer shall, not later than 4:30 p.m. on the tenth day after service by mail of this notice or not later than 4:30 p.m. on the tenth day after the last day upon which this notice is published in any county, which ever is later, file an affidavit with the Office of Elections setting forth facts showing the reasons why the Green Party of Hawaii should not be disqualified. If the Green Party of Hawaii does not file an affidavit within the time specified, this notice of intention to disqualify shall constitute final disqualification.
Upon its final disqualification, the Green Party of Hawaii shall have the right to re-qualify as a new political party by complying with the requirements of Section 11-62, Hawaii Revised Statutes.
