YOU ARE HEREBY NOTIFIED THAT Defendant, State of Hawaii have commenced a Cross-Claim in Civil No. 04-1-0317 (1), in the above-entitled Court, wherein it prays that if Plaintiff is entitled to judgment in Plaintiffs favor, that the judgment be entered against Cross-Claim Defendant and not against the State; that if it is determined that Plaintiff is entitled to judgment against the State, that the State have judgment against Cross-Claim Defendant for the entire amount thereof, together with costs, attorneys fees and expenses of this action; that if it is determined that the State and Cross-Claim Defendants are joint tortfeasors, that the relative degree of fault of each is determined and the State have judgment against Cross-Claim Defendant for any amount the State may pay over and above its pro-rata share; that the State be awarded such further relief as the court deems appropriate and just herein.
YOU ARE HEREBY SUMMONED to appear in the courtroom of the Honorable Joel E. August, Judge of the above entitled Court, in his courtroom located at 2145 Main Street, Wailuku, Maui, Hawaii on the 13th Day of March, 2007 at 8:15 o\u2019clock A. M. Of said day or to file an answer or other pleading and serve it before said day upon Reginald K.T. Yee, Defendant State of Hawaii\u2019s attorney, whose address is 425 Queen Street, Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Cross-Claim.
