NOTICE OF PUBLIC HEARINGS
Pursuant to Chapter 91, Hawaii Revised Statutes, notice is hereby given that the State of Hawaii, Department of Transportation, Airports Division, will hold public hearings to consider the following proposed changes to the Hawaii Administrative Rules.
Chapter 19-12, Airport Zoning. We are proposing to amend section 19-12-9 by repealing subsection (a). This subsection allows the construction, erection, maintenance or alteration of any structure, or the growth of a tree, to a height up to thirty-five feet above the surface of the land. Unfortunately, it is possible for a structure or tree less than thirty-five feet in height to create a hazardous situation by obstructing the air space required for the flight of aircraft in landing or taking-off at an airport. It is therefore necessary to repeal subsection 19-12-9(a). Moreover, the proposed amendment will resolve an inconsistency between section 19-12-9 and section 19-12-7 and 19-12-10.
Chapter 19-14, Public Conduct at Public Airports. We are proposing several housekeeping changes to sections 19-14-2, 19-14-3 and 19-14-3.1; specifically, we are proposing to:
a. Add a definition of service animal;
b. Replace the term seeing eye or hearing guide dog with service animal; and
c. Replace the term handicapped persons with persons with disabilities.
The proposed changes are needed to ensure compliance with the Americans with Disabilities Act.
