NOTICE OF PUBLIC HEARING
APPLICATION OF MANELE WATER RESOURCES, LLC FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY PURSUANT TO SECTION
269-7.5 TO PROVIDE SEWER SERVICE IN MANELE-HULOPOE, LANAI;
AND FOR APPROVAL OF RULES, REGULATIONS, AND RATES
DOCKET NO. 2006-0166
The PUBLIC UTILITIES COMMISSION of the STATE OF HAWAII (Commission), pursuant to Hawaii Revised Statutes (HRS) §§ 269-16 and 269-12, HEREBY GIVES NOTICE that it will hold a public hearing on Friday, September 29, 2006, at 5:00 p.m. at Lanai High and Elementary School Cafeteria, 555 Fraser Avenue, Lanai City, Lanai, Hawaii, regarding the application of MANELE WATER RESOURCES, LLC (Applicant), Docket No. 2006-0166, filed June 28, 2006, for a Certificate of Public Convenience and Necessity to provide sewer services in the area of Manele-Hulopoe, Lanai, State of Hawaii, and for approval of its rules, regulations, and rates.
Applicant, a newly formed subsidiary of Castle & Cooke Resorts, LLC (CCR), was organized for the purpose of providing the proposed sewer services in the Manele- Hulopoe area. CCR and its predecessors-in-interest have owned and operated the private sewage treatment plant and collection system in Manele, Lanai since 1991 (the Facility). The Facility currently services, free of charge, the Four Seasons Resort Lanai at Manele Bay, the Challenge at Manele golf course, Manele residential units, and Hulopoe Beach Park. The Facility will also serve the Manele boat harbor upon completion of the Manele Small Boat Harbor Capital Improvement Project, as well as customers within the Manele-Hulopoe area.
There are no competing private or public providers of the proposed services in the Manele-Hulopoe area. Applicant represents that effluent from the treatment of sewage at the Facility is R-1 water, which is provided at no cost to the Challenge at Manele golf course for irrigation purposes.
Current customers, as noted above, are not being charged for sewer services, nor for the sale of treated R-1 water. Applicant proposes to commence charging for these services at the following rates:

Applicant represents that the foregoing rates are designed to allow Applicant to only partially recover its costs for providing the proposed services. If its actual operations do not provide sufficient revenues to cover operating expenses, Applicant further represents that additional funds necessary to finance Applicants operations will be supplied by one or more of Applicants affiliates.
All interested persons are urged to attend the public hearing to state their views, orally, in writing, or both. Written statements may be submitted prior to or at the public hearing. Statements may be mailed to the Public Utilities Commission, 465 South King Street, Room 103, Honolulu, Hawaii, 96813. Statements may also be sent by electronic mail to the Commissions e-mail address at Hawaii.PUC@hawaii.gov. All written statements should reference Docket No. 2006-0166 and must include the following information: (1) name of the person submitting the written statement; (2) organization the person submitting the written statement represents (if any); and (3) address of the person submitting the written statement.
Motions to Intervene or Participate in this proceeding shall comply with Subchapter 4, Rules of Practice and Procedure Before the Public Utilities Commission, Hawaii Administrative Rules, Title 6, Chapter 61. A motion to intervene or participate in this proceeding shall be filed with the Commission by October 9, 2006.
