NOTICE OF PUBLIC HEARING
ON PROPOSED AMENDMENT TO CHAPTER 13-5,
HAWAII ADMINISTRATIVE RULES, SUBZONE BOUNDARY DESIGNATION
WITHIN THE STATE LAND USE CONSERVATION DISTRICT

The Department of Land and Natural Resources, State of Hawaii, pursuant to Chapters 91 and 183C, Hawaii Revised Statutes, will hold a public hearing to receive testimony on the following:
PETITION TO AMEND SECTION 13-5-10, HAR: Conservation District Subzone Boundary Designation at Kuna Bay, Kealia, Kauai, portion of TMK: (4) 4-7-007:029
The petitioner, County of Kauai, Department of Public Works proposes to designate the subject area of approximately 44 acres, located south of Paliku Point up to Ahihi Point into the Resource subzone. Presently the subject area is within the Conservation District without a subzone designation. The petitioner has received Conservation District Use Permit (CDUP) KA-3160 for the Kapaa-Kealia Bike and Pedestrian Path. As part of condition #19 of CDUP KA-3160, once the subzone has been designated, the applicant can implement the improvements proposed.
Any approved amendment would be reflected on the map on file with the Department referenced by Chapter 13-5, HAR, Exhibit 1 (Subzone Designation) map K-9, Anahola, and K-10, Kapaa.
A copy of the rule amendments is available on-line at: www.hawaii.gov/dlnr/occl/rules. Materials are available for review in Honolulu at the Office of the Conservation and Coastal Lands (OCCL), Department of Land and Natural Resources in Honolulu at the Kalanimoku Building, Room 131, 1151 Punchbowl Street, Honolulu, Hawaii, and at the DLNR Land Division, 3060 Eiwa St. Room 306, Lihue, Kauai. The subject amendment can be mailed to parties for a fee.
At the public hearing or within fifteen days following the close of the public hearing, any person may file with the Board a written protest or other comments or recommendations in support of or in opposition to the proposed rulemaking. The Board of Land and Natural Resources shall take final action on this rulemaking at a future regularly scheduled board meeting.
