NOTICE OF REPEAL OF ADMINISTRATIVE RULE
The University of Hawaii, pursuant to Hawaii Revised Statutes Chapter 91, subsection 91-3(f), hereby gives thirty days’ public notice that it intends to repeal Title 20, Chapter 42 of the Hawaii Administrative Rules entitled “Hawaii State Postsecondary Review Program” (for convenience referred to as “Chapter 20-42”). The proposed effective date of the repeal shall be June 14, 2017, or as soon thereafter as certified copies of the repeal have been filed with the Office of the Lieutenant Governor.
Chapter 20-42 sets forth the rules and procedures governing the Hawaii Postsecondary Review Program established by Part II of HRS Chapter 305H. The University had certain oversight responsibility for postsecondary education under that program. However, HRS Chapter 305H was repealed in 2006 and the postsecondary review responsibilities of the former program were moved to the Hawaii Department of Commerce and Consumer Affairs (“DCCA”) in 2013 when HRS Chapter 305J was enacted. In light of the repeal of the Hawaii State Postsecondary Review Program and the transfer of the postsecondary review responsibilities to the DCCA, Chapter 20-42 serves no purpose and will be repealed in its entirety.

The full text may also be viewed until May 31, 2017, between the hours of 9:00am – noon and 1:00pm – 4:00pm at the UH System Government Relations Office located at the University of Hawaii at Manoa, 2444 Dole Street, Bachman Hall 109J, Honolulu, Hawaii 96822, and at regional public libraries.
Any interested person may petition the University Board of Regents regarding the proposed repeal of Chapter 20-42 by submitting a petition to the Board pursuant to Section 91-6, Hawaii Revised Statutes, at 2444 Dole Street, Bachman 209, Honolulu, Hawaii 96822, no later than May 31, 2017.
