NOTICE OF PUBLIC HEARING ON
CHANGES TO HAWAII ADMINISTRATIVE RULES (HAR), TITLE 11,
CHAPTER 20, ENTITLED “RULES RELATING TO PUBLIC WATER SYSTEMS”
STATE DEPARTMENT OF HEALTH

The Department of Health (DOH) will receive written comments and hold a public hearing on proposed changes to Hawaii Administrative Rules (HAR), Chapter 11-20, Rules Relating to Public Water Systems. The Revised Total Coliform Rule (RTCR) was published in the Federal Register on February 13, 2013. The RTCR was subsequently codified in Title 40, Code of Federal Regulations, primarily Parts 141 and 142. The initial compliance date for public water systems was April 1, 2016. The RTCR affects all public water systems in the state. Its primary purpose is to reduce the entry of fecal contamination into distribution systems. A total of 135 public water systems, serving approximately 1.5 million customers on the islands of Kauai, Oahu, Molokai, Lanai, Maui and Hawaii, must comply with the RTCR.

The proposed significant changes are summarized as follows:

1. The revisions to HAR, Chapter 11-20 are entirely federally mandated.
2. Routine and repeat sample monitoring requirements will be revised.
3. Based on monitoring results, assessments will be required to address fecal contamination that could enter into public water systems.

The public hearing will be held on Oahu on Wednesday, March 15, 2017, at 1:30 p.m., in the 5th floor conference room of 919 Ala Moana Boulevard, Honolulu. Persons desiring to speak are asked to submit two (2) copies of their statement before or at the hearing. Written statements will also be accepted until 4:30 p.m. on March 16, 2017, at the Safe Drinking Water Branch (SDWB) Oahu address noted below.

Copies of the proposed rules and documents explaining the proposed changes are available for review Monday through Friday (excluding holidays) from 7:45 a.m. until 4:15 p.m., at the following locations:
