NOTICE OF SALE AND DISPOSITION
OF STATE-OWNED FIRE RESPONSE VESSEL
BY PUBLIC AUCTION
Notice of Sale of Surplus Property at public action through the receipt of competitive sealed bid is hereby given that a 110’ steel fire response vessel named “MOKU AHI” is being offered by the HAWAII DEPARTMENT OF TRANSPORTATION (DOT), HARBORS DIVISON. Pursuant to Hawaii Administrative Rule 3-130-10(C). The Notice of Sale is posted at Harbors Division, Oahu District Office, 700 Fort Street, Honolulu, HI, 96813, the site of the sale.
Sealed bids shall be delivered in-person to the office of the Oahu Harbor District at 700 Fort Street, Pier 11 Gallery, Honolulu, HI, 96813, no later than Friday, November 4, 2016 (2:00 p.m. at which time and place(s) the sealed bids will be publicly opened and read. The Item shall be sold as-is, where-is with no warranties expressed or implied. Bidders are informed that the DOT and the State of Hawaii offers and gives no guarantees or warranties to the buyer of the 110’ steel fire response vessel named “MOKU AHI” and items on or attached to the vessel (hereinafter “Item”); major defects, if known are listed, and the DOT and the State makes no claim that all defects are known. Bidders are informed that no sale shall be invalid if defects are discovered in the Item discovered after the sale. The DOT and State assumes no responsibility or liability once the Item is sold.
On November 4, 2016 and after 2:00 p.m., when the sealed bid(s) is publicly opened and read, the bidder with the highest U.S. dollar sealed bid shall be awarded the Item, hereinafter “Buyer”. Buyer is responsible to remove the Item within the stipulated time after purchase. The DOT exercises its discretion that the Buyer will not be charged the current published dockage fee pursuant to HAR 19-44-17; however, Buyer shall provide the Oahu Harbors District with proof of salvage and fire insurance not less than three hundred thousand dollars ($300,00) and within five (5) calendar days from the date when the sealed bid(s) is publicly opened and read.
The DOT will issue a Bill of Sale no later than three (3) working days from the receipt of the Buyer’s proof of Insurance.
The Oahu Harbor Commercial Harbor Manager (hereinafter “Harbor Master”), at his sole discretion, may grant the Buyer an additional thirty (30) calendar days and the Buyer is notified that Full Dockage rates will be applied pursuant to 19-44-20. The DOT limits the Oahu Harbor Commercial Harbor Manager authority to extend the vessel stay not to exceed a total of sixty (60) calendar days from the date sealed bids were publicly opened and read. Due to limited space, the vessel shall depart Honolulu Harbor immediately after the authorized stay at Pier 15 or other authorized pier.
Information packets can be obtained by written request or in person during the hours of 7:45 a.m. to 4:00 p.m., Monday through Friday, at the DOT, Harbors Division, Oahu District Office, at 700 Fort Street, Honolulu, HI, 96813; or, by PDF to the Oahu District Office at jeffrey.s.prather@hawaii.gov.
Interested bidders may inspect the vessel and its contents at their own risk. Interested parties must arrange an appointment for a visit by calling Mr. Jeffrey S. Prather at (808) 587-2056. during the hours of 8:00 a.m. to 3:00 p.m., Monday through Friday, excluding state and federal holidays.
Interested parties are informed of the requirement for the purchaser to remove the vessel from its present location at Pier 15, Honolulu Harbor, at sole cost and risk to buyer, as specified herein. The sale includes the subject vessel plus any contents and fixtures which are on the boat. Interested bidders shall have attached to their competitive sealed bids a certified check or bank cashiers’ check the minimum bid in the amount of three thousand dollars ($3,000) to the “”Department of Transportation – Harbors Division Special Fund”. If the competitive sealed bid exceeds the $3,000, the balance shall be paid by cash, certified check, or bank check no later than 2:00 pm the following working day of bid opening. Successful bidders shall remit their payments in the form of Bank Cashier’s or Certified Check drawn on US banks only, and a Bank Wire Transfer for any amount over $10,000. Failure to pay balance by deadline shall result in forfeiture of the minimum bid to DOT as liquidated damages. Checks should be delivered attention to Mr. Jeffrey S. The sale shall be made in accordance with the provisions of the notice of sealed bid sale to the highest responsive and responsible bidder, provided that the price offered by such bidder is acceptable to the State. If the State determines the bid is not advantageous to the State, the State may reject the bids in whole or in part and may re-solicit bids or may negotiate the sale, provided that the negotiated sale price is higher than the highest responsive and responsible bidder.
Failure to remove vessel by the deadline or within the 60 calendar days will result in default in meeting the terms of the sale and forfeiture of monies paid. DOT will retain all amounts collected as damages to not having the Pier 15 berth available for the Oahu Harbor District’s use and control. In the event successful bidder fails to pay balance by deadline, or remove vessel by deadline, DOT may-at its discretion-offer the sale to the next highest bidder in US dollars. The next successive Bidder will be subject to the same terms, conditions and deadlines as high bidder before default and forfeiture of monies paid.
DOT reserves the right to cancel the sale or remove any item from the sale. The stated item is under the custody of the DOT. Trespassing is prohibited.
If the vessel is not sold by sealed bid sale, it may be otherwise sold or disposed of in accordance with Hawaii Administrative Rule 3-130.
