NOTICE OF PUBLIC HEARING

The following proposed amendments are based on State laws, pursuant to sections 91-3 and 92-41, Hawaii Revised Statutes. Notice is hereby given that the Department of Human Services, Med-QUEST Division will hold a public hearing to consider the proposed amendment of rules.

There are nine chapters considered with a brief description of the proposed amendments listed below:

CHAPTER 17-1715 – CHILDREN GROUP:

The proposed amendments to Chapter 17-1715 are housekeeping measures to address certain provisions of the Patient Protection and Affordable Care Act, as amended by the Health Care and Education Reconciliation Act, both enacted in 2010, (collectively referred to as the Affordable Care Act). In addition, the proposed amendments are to clarify existing policy.

CHAPTERS 17-1715.1 – FORMER FOSTER CARE CHILDREN GROUP:

The proposed amendments to Chapters 17-1715.1 are housekeeping measures to address certain existing codified Medicaid eligibility regulations and under the provisions of the Patient Protection and Affordable Care Act, as amended by the Health Care and Education Reconciliation Act, both enacted in 2010, (collectively referred to as the Affordable Care Act), clarification of policy and to help ensure correct implementation of the federal rules.

CHAPTER 17-1716 – PREGNANT WOMEN GROUP:

The proposed amendments to Chapter 17-1716 are housekeeping measures to address certain provisions of the Patient Protection and Affordable Care Act, as amended by the Health Care and Education Reconciliation Act, both enacted in 2010, (collectively referred to as the Affordable Care Act). In addition, the proposed amendment is to clarify treatment of certain pregnant individuals.

CHAPTER 17-1717 – PARENTS AND OTHER CARETAKER RELATIVES GROUP:

The proposed amendments to Chapter 17-1717 are housekeeping measures to address certain provisions of the Patient Protection and Affordable Care Act, as amended by the Health Care and Education Reconciliation Act, both enacted in 2010, (collectively referred to as the Affordable Care Act). In addition, the proposed amendment is to revise categorical requirements.

CHAPTER 17-1718 – ADULTS GROUP:

The proposed amendments to Chapter 17-1718 are housekeeping measures to address certain provisions of the Patient Protection and Affordable Care Act, as amended by the Health Care and Education Reconciliation Act, both enacted in 2010, (collectively referred to as the Affordable Care Act). In addition, the proposed amendments are to clarify existing policy and revise categorical requirements.

CHAPTER 17-1719 – AGED, BLIND, AND DISABLED GROUP:

The proposed amendments to Chapter 17-1719 are housekeeping measures to address certain existing codified Medicaid eligibility regulations to provide clarity and consistency to this chapter.

CHAPTER 17-1720 – BENEFITS PACKAGE:

The proposed amendments to Chapter 17-1720 are housekeeping measures to clarify and to provide consistency to this chapter. In addition, the following proposed amendments are to align the limitations for services as established under the Fee-For-Service program.

17-1724.1 – MODIFIED ADJUSTED GROSS INCOME (MAGI)-EXCEPTED BASED METHODOLOGY; AND
17-1724.2 – MODIFIED ADJUSTED GROSS INCOME (MAGI) BASED INCOME METHODOLOGY:

The proposed amendments to Chapters 17-1724.1 and 17-1724.2 are housekeeping measures to address certain existing codified Medicaid eligibility regulations and under the provisions of the Patient Protection and Affordable Care Act, as amended by the Health Care and Education Reconciliation Act, both enacted in 2010, (collectively referred to as the Affordable Care Act), clarification of policy and to help ensure correct implementation of the federal rules for these chapters.

A copy of the proposed amendments will be available for public viewing from the first working day that the legal notice appears in the Honolulu Star-Advertiser, Hawaii Tribune Herald, West Hawaii Today, The Maui News, and The Garden Island for a period of thirty days after the publication of this notice, from Monday – Friday, exclusive of state holidays. A copy is available between the hours of 9:00 a.m. to 2:00 p.m., on Oahu at 601 Kamokila Boulevard, Room 518, Kapolei, Hawaii 96707; at 801 Dillingham Boulevard, 3rd Floor, Honolulu, Hawaii 96817; and at the appropriate Med-QUEST Division offices on their respective islands listed above.

Special accommodations are available (i.e., interpreter, sign language interpreter, large print, taped materials, or accessible parking) if arrangements are requested no later than seven (7) working days before the scheduled public hearing.
