NOTICE IS HEREBY GIVEN that pursuant to Hawaii Revised Statutes (“HRS”) Chapters 91 and 269E and Hawaii Administrative Rules (“HAR”) Chapter 6-83, the HAWAII PUBLIC UTILITIES COMMISSION (“Commission”) will hold a show cause hearing to determine whether Kiewit Infrastructure West Co. (“RESPONDENT”) should be assessed a civil penalty, pursuant to HRS § 269E 14, for failure to comply with HRS § 269E-7, in that RESPONDENT allegedly failed to notify the Hawaii One Call Center (“Center”) of excavation, or alternatively, failed to notify the Center at least five (5) working days, but not more than twenty-eight (28) calendar days, prior to commencing excavation, and, for allegedly violating HRS § 269E-12(a) and (b) by failing to follow proper excavation procedures.
The Commission directs RESPONDENT to appear before the Commission at the hearing to be held in the Commission’s hearing room, 465 South King Street, Room B-3, Honolulu, Hawaii, at 9:00 a.m., Tuesday, April 5, 2016. RESPONDENT may be represented by an attorney of its own choosing or an officer or authorized employee of the corporation. If RESPONDENT fails to appear at the scheduled hearing, the Commission may, pursuant to HAR § 6-83-94, impose the maximum amount of penalties and assessments allowed under HRS § 269E-14.
