NOTICE OF REPEAL OF ADMINISTRTIVE RULES

Pursuant to Hawaii Revised Statutes chapter 91, notice is hereby given that the Department of Health (DOH) proposes to repeal chapter 23-202, Hawaii Administrative Rules, entitled “Medical Use of Marijuana,” on December 23, 2015, or as soon thereafter as the repeal can be filed with the Office of the Lieutenant Governor and become effective. Chapter 23-202 is the Department of Public Safety’s rules for the medical use of marijuana, registration of qualifying patients, and procedures for the implementation of Act 228, Session Laws of Hawaii 2000. This chapter has become unnecessary due to the adoption of chapter 11-160, Hawaii Administrative Rules, also entitled “Medical Use of Marijuana,” which became effective on July 18, 2015. Chapter 11-160 establishes the medical marijuana registry program at DOH, including the process for DOH to approve debilitating medical conditions, physician requirements to participate in the medical marijuana program, registration of qualifying patients and primary caregivers, monitoring and investigations, administrative procedures, and confidentiality of information.

The full text may also be viewed until January 21, 2016, from 7:45 a.m. to 4:30 p.m. at the DOH HARM Reduction Services Branch office located 728 Sunset Avenue, Honolulu, Hawaii 96816.
Any interested person may petition the DOH regarding the chapter to be repealed by submitting a written petition to the DOH at 3627 Kilauea Avenue, Room 306, Honolulu, Hawaii 96816 no later than January 21, 2016.
