Notice is hereby given that the Council of the County of Kaua’i will hold a public hearing on Wednesday, August 19, 2015 at 1:30 p.m., or soon thereafter, at the Council Chambers, 4396 Rice Street, Room 201, Historic County Building, Lihu’e, on the following:

A BILL FOR AN ORDINANCE AMENDING ORDINANCE NO. B-2015-796, AS AMENDED, RELATING TO THE OPERATING BUDGET OF THE COUNTY OF KAUA’I, STATE OF HAWAI’I, FOR THE FISCAL YEAR JULY 1, 2015 THROUGH
JUNE 30, 2016, BY REVISING THE AMOUNTS ESTIMATED IN THE GENERAL FUND AND SEWER FUND (Kaua’i Lagoons Resort Wastewater Treatment Capacity Assessment Refund – $758,550)

This Bill proposes to amend Ordinance No. B-2015-796, as amended, relating to the Operating Budget of the County of Kaua’i, State of Hawai’i, for the Fiscal Year July 1, 2015 through June 30, 2016, by revising the amounts estimated in the General Fund, Equity/Fund Balance – Unassigned in the amount of $758,550 and appropriating the funding to the Sewer Fund, Contributions and Refunds.

Pursuant to the Kaua’i County Council’s approval of the Lihu’e Wastewater Treatment Plant Effluent Upgrade Agreement in 2009 and the completion of the development of the “R-1 Upgrade Project” for the Lihu’e Wastewater Treatment Plan funding is necessary to refund the Kaua’i Lagoons Resort for the Wastewater Treatment Capacity Assessment.

A BILL FOR AN ORDINANCE TO AMEND SECTION 2, ORDINANCE NO. 891 AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE COUNTY OF KAUA’I FOR THE PURPOSE OF FINANCING CERTAIN PUBLIC IMPROVEMENTS AND REFUNDING CERTAIN BONDS OF THE COUNTY; FIXING OR AUTHORIZING THE FIXING OF THE FORM, DENOMINATIONS, AND CERTAIN OTHER DETAILS OF SUCH BONDS AND PROVIDING FOR THE SALE OF SUCH BONDS TO THE PUBLIC

As advised by the County of Kaua’i’s Bond Counsel, the purpose of this Bill is to amend Section 2 of Ordinance No. 891, which incorporates the Capital Improvement Projects (CIP) outlined in the County of Kaua’i’s Capital Budget Ordinance for Fiscal Year 2015-2016, to receive proper financing through General Obligation Bonds. Procedurally, this amendment is necessary to assure that any new CIP Projects are in accordance with the Bond Ordinance.

All interested persons who wish to present their comments may do so at the public hearing. Written testimony prior to the hearing would be appreciated. Written testimony can be submitted to the Office of the County Clerk, Council Services Division by mail, facsimile, or via E-mail to counciltestimony@kauai.gov. Copies of the proposed Bills are available at the Office of the County Clerk, Council Services Division.
