For the Repeal of the Amended Policy, Rules and Regulations Governing
Camping at City Parks and to Adopt Proposed
City and County of Honolulu Administrative Rules,
Title 19, Chapter 10, Rules and Regulations Governing Campin

Notice is hereby given of proposed rule repeal, rulemaking and public hearing by the Department of Parks and Recreation, City and County of Honolulu, to consider the repeal of the Amended Camping Policy, Rules and Regulations Governing Camping at City Parks (“current rules”) and the adoption of Proposed City and County of Honolulu Administrative Rules, Title 19, Chapter 10, rules and regulations governing camping (“proposed rules”).

The Department of Parks and Recreation proposes to repeal the current rules regulating camping at city parks for the purpose of converting the current rules to the Hawaii Administrative rules form and adopting new rules governing camping. The proposed rules add new definitions and clarify existing definitions of activities subject to rules, add new permit conditions, establish deadlines, and permit fees, establish new regulations governing camping at city parks, new requirements governing indemnification and penalties for violation of the rules.

The proposed new rules are summarized as follows:

§19-10-3: Definitions have been added and existing definitions have been amended.
§19-10-4: Penalties for violating any provision of this chapter or terms and conditions of the permit.
§19-10-5: Severability provision.
§19-10-6: A camping permit required for camping in designated campgrounds.
§19-10-7: Camping fees and no-refund policy.
§19-10-8: General permit application procedures, to include types of camping permits, permit restrictions, application deadlines, rejection of applications received prior to application time periods, wait-list, campsite hours, and use of the online reservation system.
§19-10-9 Special camping permit procedures for Ho’omaluhia Botanical Gardens and Bellows Beach Park, including hours of operation, vehicle restrictions, towing of vehicles, and parking regulations.
§19-10-10: Listing of campground and campsites, hours of operation, restrictions and number of campsites.
§19-10-11: General permit conditions including provisions regulating scope of permit, use of campsites, including restrictions on camping equipment, quiet hours, size of tents, parking permit requirements, vacating the campsite, disposition of property remaining at the campsites, and prohibitions on animals, alcohol, commercial activities, non-camping equipment, and sound-amplifying equipment.
§19-10-12: Criteria and procedures under which permits may be revoked, denied, and the appeal procedures.
§19-10-13: Indemnification and assumption of risk by permittee.
§19-10-14: Closing of campgrounds and campsites by the director or an authorized representative for the protection, restoration and preservation of areas and facilities or the health, safety and welfare of persons or property. Prohibits day use and picnicking at c ampgrounds during closure hours.

A public hearing will be held on January 14, 2015, in the Hearing Room of the Mission Memorial Building at 550 South King Street, Honolulu Hawaii 96813, starting at 2:00 p.m. and ending at 4:00 p.m.

All interested persons are urged to attend the public hearing and present data, views, or arguments in the time limit provided, for consideration by the Department of Parks and Recreation. Persons unable to attend or wishing to present additional comments may mail written testimony to the Department of Parks and Recreation, Executive Services Division, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707, no later than January 22, 2015.

Interested persons may review the current rules to be repealed and proposed rules starting today and ending five days prior to the day of the public hearing during the hours of 7:45 a.m. to 4:30 p.m. at the Department of Parks and Recreation, 1000 Uluohia Street, Suite 309, Kapolei, Hawaii 96707.

A copy of the rules to be repealed and proposed rules shall be mailed to any person who submits a written request to the above address and pays the required fee of $13.82 for the cost of duplicating the documents and postage. A complete set of the current rules to be repealed and proposed rules is also available, free of charge, on the City’s internet web site: http://www. Honolulu.gov/parks/.
