Notice of Contested Case Hearing


Regarding Contested Case OA-08-02 for Conservation District Use Application (CDUA) OA-3413 for the Liljestrand Single Family Residence (SFR), located at 3300 Tantalus Drive, Honolulu, Island of Oahu, Subject Parcel TMK: (1) 2-5-011:008.

The Board of Land and Natural Resources (BLNR), State of Hawaii, will conduct a Contested Case Hearing on DLNR File No. OA-08-02 regarding CDUA OA-3413. The hearing will be held pursuant to Chapters 91 and 183C, Hawaii Revised Statutes, and Chapters 13-1 and 13-5, Hawaii Administrative Rules (HAR). The issues involve whether a Conservation District Use Permit should be granted to the applicants to change the use of the Liljestrand’s Single Family Residence (SFR) to a part-time SFR to accommodate the following uses: 1) as a rental to pre-qualified selected individuals and families for a 30 day period (not to exceed six times per year); 2) as a location for filming movies, and TV programs (not to exceed three times per year); 3) as a venue for commercial photography shoots; 4) for small group tours for architects, photographers, historians, educators, artists, etc.; 5) as a venue place for meeting’s, seminars, workshops, ceremonies, fundraisers, receptions, dinners, lunches, breakfasts and other similar social events for groups (not to exceed 100 people at one time); and 6) venue for dispute prevention and resolution activities (includes consulting, coaching, training, planning, facilitation, negotiation, mediation, arbitration sessions, etc.). The activities will enable the Liljestrand family to continue to use their SFR, and to financially retain and maintain the property. The BLNR has appointed a Hearing Officer to conduct the contested case hearing and the hearing on standing. The hearing on standing will commence at 10:00 AM on Friday, February 1, 2008, which will commence at 10:00 AM, at the Kalanimoku Building, 1151 Punchbowl Street, Board Room 132, Honolulu, Hawaii.

Any person wishing to participate in the hearing as an intervening party must file a written application in conformance with Section 13-1-31, HAR, explaining briefly how he or she has a specific legal interest different from the general public and how this interest could be affected by the proposed action. Only persons determined to have standing and admitted as parties to the proceedings will be allowed to participate in the contested case hearing. Any party may retain counsel if desired. An individual may appear on his or her own behalf, or a member of a partnership may represent the partnership, or an officer or authorized employee of a corporation or trust or association may represent the corporation, trust or association. All parties shall be afforded the opportunity to present and cross-examine evidence and witnesses and make arguments on issues before the BLNR.

Written applications to intervene must be received no later than 4:30 PM, Friday, January 25, 2006, at the Department of Land and Natural Resources, Office of Conservation and Coastal Lands, Room 131, 1151 Punchbowl Street, Honolulu (or P.O.
