NOTICE OF RECEIPT AND INVITATION FOR PUBLIC COMMENT
CONSERVATION DISTRICT USE APPLICATION (CDUA) HA-3443
EXPANSION OF OPEN OCEAN FISH FARM, NORTH KONA, HAWAII

The Department of Land and Natural Resources (department), State of Hawaii, pursuant to Chapter 190D, Hawaii Revised Statutes, hereby issues public notice of receipt and invites public comment regarding:

Conservation District Use Application (application) HA-3443 for the expansion of the Kona Blue Water Farms, Open Ocean Fish Farm, Pen and Cage Aquaculture Facility in State Marine Waters, 0.5 miles offshore of the Natural Energy Laboratory of Hawaii Authority (NELHA), southwest of Ulualoha Point, North Kona, Hawaii.

Furthermore, pursuant to Section 190D-11(b), Hawaii Revised Statutes, the department includes the following information in this notice and invitation related to the above application:

1. The state marine waters for which the application has been made:

The total area of surface, seafloor and water column of State marine waters
and submerged lands for the expansion of the existing facility is proposed to
be approximately 13-acres. The expansion area is proposed to be
approximately 2,400-feet from the shoreline.

2. The nature of the exclusive use sought:

The applicant intends to use the submerged lands for the anchoring system.
The existing restrictions to public activities will be required for safety, security
and liability. The public shall be permitted to transit the site and fish from
boats in the subject area, but no anchoring, SCUBA diving or swimming in
the area is requested.

3. The purpose for which the application has been made:

The purpose of the expanded area is to reconfigure the mooring grid to
accommodate larger net pens. Kona Blue proposes to double the capacity
of the net pens from the existing 2,800-3,200 cubic meter volume pens
to 6,200 cubic meter volume pens. The number of pens shall remain the
same at eight pens. The expanded lease area would contain only the
anchor lines.

A copy of the application, the project\u2019s Environmental Assessment and maps of the general location of the area under consideration are available for inspection at the Office of Conservation and Coastal Land, Department of Land and Natural Resources, Kalanimoku Building, Room 131, 1151 Punchbowl Street, Honolulu, Hawaii, 96809.
