WASTEWATER SYSTEMS
PUBLIC NOTICE OF
VARIANCE APPLICATION NO. WW 257
DOCKET NO. 07 – VWW – 15

Pursuant to H.R.S. §342D-7(i), Hawaii Revised Statutes, the State Department of Health (DOH) seeks written comments from interested persons regarding the following. Dale & Tracy Leverone of Kailua- Kona, Hawaii have applied for a five (5) year variance from Hawaii Administrative Rules (HAR), Section 11-62-31.1(b)(1) which states “For residential developments. There shall be 10,000 square feet of land area for each individual wastewater system.”
Mr. Stephen J. Herbert of Stephen J. Herbert, P.E., Inc. is the individual authorized to act for the applicant. The applicant has stated that the total area of the subject property is 18, 282 square feet. The lot has two (2) dwelling units, a three (3) bedroom and five (5) bedroom dwelling on it. Wastewater from the two dwellings is disposed of by means of a common cesspool. Thr front dwelling (3-bedroom) will remain connected to the cesspool. The back dwelling (5-bedroom) will be served by a new septic tank and seepage pit. The property is located at 73-1186 Ahikawa Street, Kailua-Kona, Hawaii, and further identified as TMK: (3) 7-7-022:016.
The applicant has made the folling comments.
1. The area of the lot is 18,282 square feet. This is
insufficient to meet the minimum land
area requirements for individual wastewater
system (IWS) utilization which is one IWS
per 10,000 square feet of lot area.
2. The existing large capacity cesspool(s) must be
closed and replaced with a new treatment
individual wastewater system by April 5, 2005 to
comply with federal requirements.
3. The existing LCC will be upgraded to an IWS
(septic system). The IWS will provide a better
treatment system prior to effluent disposal. The
IWS will be designed and constructed to meet
the Department of Health standards. The impact
to the environment will be minimized compared
to the current wastewater disposal.
4. The residents of the dwelling are essentially
economically depressed.
5. The variance is requested for the maximum of
five (5) years.
