Public Hearings


Pursuant to sections 91-3 and 92-41, Hawaii Revised Statutes (HRS), the Department of Health (“Department”) will receive written comments and hold a public hearing to receive testimony on its adoption of Hawaii Administrative Rules (HAR), Chapter 452 of Title 11, “Requirements for Decontamination and Cleanup of Methamphetamine Manufacturing Sites”.

The subjects and purposes of the adoption of HAR, Chapter 452 of Title 11, are to:

1. The State Legislature and the Department find that the contamination of any properties located in the State used to illegally manufacture or store methamphetamine poses a threat to public health and welfare, the environment, and to the health of the State’s first responder community.

2. Currently there are State interim rules for the emergency and long-term decontamination and cleanup of properties that have been used to illegally manufacture or store methamphetamine and its precursor hazardous materials. State law requires final rules for the proper decontamination of such properties, and the protection of first responders, by December 31, 2007.

3. This rule governs the interaction between the Department and Federal, State, and County law enforcement agencies during illegal methamphetamine manufacturing site decontamination, and provisions for Department oversight of hired private cleanup contractors through the duration of the site remediation process.

All interested persons shall be afforded an opportunity to submit testimony orally or in writing at the time of the hearing. Any persons desiring to give written testimony are asked to submit two (2) copies of their testimony at the hearing, or before, to the address below. Written testimony will also be accepted until close of business on October 21, 2007, at the:
