PUBLIC NOTICE
The Department of Health, State of Hawaii is notifying all interested persons of the proposed settlement between the Department of Health and Hawaiian Electric Company, Inc. The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 05-CA-EO-5, alleging that Hawaiian Electric Company, Inc. violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, and Covered Source Permit No. 0239-01-C by emitting visible emissions from its Waiau Unit 8 greater than 40 percent opacity for a six minute averaging period, specifically on November 1 and 2, 2004. Waiau Unit 7 emitted visible emissions greater than 40 percent opacity for a six minute averaging period, specifically on November 11, 2004 and March 17, 2005. Waiau Units 7 and 8 are located at 475 Kamehameha Highway, Pearl City, Hawaii.
A Consent Order has been drafted that proposes to settle this case and an undocketed case involving opacity exceedences occurring at the Hawaiian Electric Company Inc. Kahe Generating Station in Kapolei and Honolulu Generating Station in Honolulu, Oahu. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice. The proposed Consent Order and the Notice and Finding of Violation and Order may be reviewed at the Clean Air Branch in Honolulu at 919 Ala Moana Boulevard, Suite 203.
