NOTICE OF PUBLIC HEARING ON WATER POLLUTION RULES
DEPARTMENT OF HEALTH
STATE OF HAWAII
DOCKET NO. R-6-07
August 6, 2007

The Department of Health will receive written comments and hold a public hearing on proposed changes to Hawaii Administrative Rules (HAR), Chapter 11-55, Water Pollution Control.

The topics and general description of the proposed changes are to:

1. Readopt Eleven (11) National Pollutant Discharge Elimination System General Permits. This will continue a significant streamlined permitting process for those activities which are eligible;
2. Excuse from National Pollutant Discharge Elimination System permitting certain pesticide use to control vectors when pesticides are applied properly. This complies with Application of Pesticides to Waters of the United Sates in Compliance with Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) regulations promulgated in Federal Register, Vol. 71, No. 227, Pages 68483-68492 (71 FR 68483-68492), dated November 27, 2006, and on Friday, December 1, 2006, in 71 FR 69622 (date was corrected);
3. Adopt regulations to enable the use of Field Citations for four (4) specified cases;
4. Update of references to reflect the latest changes of the Hawaii Revised Statutes (HRS); Code of Federal Regulations, Title 40 (40 CFR); and the Clean Water Act (Act);
5. Comply with the 40 CFR, revised as of July 1, 2006;
6. Conform with the HAR Format specified in the Hawaii Administrative Rules Drafting Manual, Second Edition, June 1984 by the Legislative Reference Bureau; and
7. Revise for clarity and consistency with policies and corrections of errors.

The public hearing will be held on Oahu at 2:00 p.m. on Thursday, September 6, 2007, in the 5th Floor Conference Room of 919 Ala Moana Boulevard, Honolulu. Video Conference Center Sites will be open from 2:00 p.m. on Thursday, September 6, 2007, at the following locations:

Persons desiring to speak are asked to submit two (2) copies of their statement before or at the hearing. Written statements will also be accepted until 4:30 p.m. on Thursday, September 6, 2007, at the Clean Water Branch, Environmental Management Division, State Department of Health, 919 Ala Moana Boulevard, Room 301, Honolulu, Hawaii 96814-4920.
