NOTICE OF PUBLIC HEARING
Pursuant to Sections 91-3 and 92-41, Hawaii Revised Statutes, notice is hereby given that the Hawaii Housing Finance and Development Corporation (HHFDC), Department of Business, Economic Development and Tourism (DBEDT), State of Hawaii, will hold a public hearing on August 31, 2007 at 10:30 a.m. to consider the adoption of Chapter 15-306, \u201DGeneral Excise Tax Exemptions,\u201D Hawaii Administrative Rules (HAR) and the repeal of Chapter 17-2013, \u201DGeneral Excise Tax Exemptions,\u201D HAR.
Act 196, Session Laws of Hawaii 2005, bifurcated the Housing and Community Development Corporation of Hawaii (HCDCH) into the Hawaii Public Housing Authority and the HHFDC, and provided that the HCDCH administrative rules remain in effect until amended. The means by which this transition will be accomplished is by repeal of the relevant HCDCH rule and repromulgation of it under the HHFDC.
The HHFDC is also making the following substantive amendments to this rule:
1. Section 15-306-1 clarifies that economic feasibility and production of as many lower cost housing units as possible are criteria used by the HHFDC in determining eligibility for certification for an exemption from general excise taxes (GET).
2. Section 15-306-14 now states that economic feasibility will be considered in determining an affordable housing project\u2019s eligibility for certification for exemption from general excise taxes.

All interested persons are invited to attend the hearing and state their views relative to the proposed rule either orally or in writing. Should written testimony be presented, five copies shall be made available to the presiding officer at the public hearing or within seven days before the hearing to:
