PUBLIC NOTICE OF
VARIANCE APPLICATION NO. WW 247
DOCKET NO. 07 – VWW – 05

Pursuant to Hawaii Revised Statutes §342D-7(i), the State Department of Health (DOH) seeks written comments from interested persons regarding the following. Honolua Plantation Land Co., P.O. Box 187, Kahului, Maui, Hawaii 96733-6687 has applied for a variance for the maximum of five (5) years stated from Hawaii Administrative Rules from Section 11-62-31.1(a)(1) regarding the use of individual wastewater systems as a temporary on-site means of wastewater disposal in lieu of wastewater treatment.
Mr. Jeffrey T. Pearson, Water Manager for Maui Land & Pineapple Co. is the individual authorized to act for the applicant. The applicant is requesting the continued use of individual wastewater systems (IWSs) for the 47 home Puu Koa Subdivision, which is located in Makawao, Maui, Hawaii, and identified as TMK: (2) 2-3-063: 001-047.
The applicant has made the following comments.
1. Each residence has an IWS for the dwelling.
2. Lots for dwellings range in size from 5,400 to 8,147 square feet. DOH requirements are for a minimum 10,000 square feet.
3. Compliance with DOH rules would produce serious hardships without equal or greater benefits to the public.
4. Prior variances were issued for a five (5) year period. This is the requested time period.
Previous Decision and Orders (Granted February 20, 2002) and Findings of Fact and Conclusions of Law (Dated December 30, 1996) were attached to this application for variance but can not be shown here. The final decision will be made on the basis of the application, related documents, written comments and the public hearing, if any.
