NOTICE OF PUBLIC HEARING
DEPARTMENT OF HEALTH

Pursuant to sections 91-3 and 92-41, Hawaii Revised Statutes (HRS), the Department of Health will receive written comments and hold a public hearing to receive testimony on its repeal of Hawaii Administrative Rules (HAR), Chapter 11-110, Clinical Laboratories and Laboratory Personnel, and its adoption of proposed Chapter 11-110.1, Clinical Laboratories and Laboratory Personnel.
The subjects and purposes of the proposed changes made by the repeal of Chapter 11-110 and the adoption of Chapter 11-110.1 are to:
1. Define authorized persons who are able to order and receive results of laboratory tests;
2. Establish a permit process for sites performing waived tests and provider-performed microscopy procedures and defines what types of laboratory tests can be performed, and the personnel required; and
3. Establish a process for foreign educated/trained personnel to work in clinical laboratory settings at an entry level, and with sufficient experience and training, then be able to apply for licensure at a higher level commensurate with their education.
The proposed changes may also include housekeeping amendments to the rules and amendments, deletions, or additions suggested by oral or written testimony.
All interested persons shall be afforded an opportunity to submit testimony orally or in writing at the time of the hearing. Any persons desiring to give written testimony are asked to submit two (2) copies of their testimony at the hearing, or before the hearing at the address below. Written testimony will be accepted until close of business on May 14, 2007 at the:
