NOTICE OF PUBLIC HEARING
DEPARTMENT OF HEALTH
STATE OF HAWAII

Pursuant to sections 91-3 and 92-41, Hawaii Revised Statutes (HRS), the Department of Health will receive written comments and hold a public hearing to receive testimony on its repeal of Hawaii Administrative Rules (HAR), Chapter 11-104, Management of Infectious Waste, and its adoption of proposed Chapter 11-104.1, Management of Infectious Waste.
The subjects and purposes of the proposed changes made by the repeal of Chapter 11-104 and the adoption of Chapter 11-104.1 are to:
1. Allow for the inclusion of amendments made to HRS Chapter 321 by the 2006 legislature concerning the release of the human placenta by the hospital to the woman from whom it originated or to the womans designee upon negative findings of infection or hazard after appropriate testing of the mother.
2. Incorporate current standards of practice for treatment and disposal of infectious waste consistent with the Centers for Disease Control and Prevention, the Environmental Protection Agency, the Clinical Laboratory Institute for Clinical Laboratory Waste Management and the Occupational Safety and Health Administration, and other similar guidelines.
3. Add subchapters to provide clarity in the management of treated versus untreated waste, standards for infectious waste generators and transporters, and any enforcement action that the department may take to ensure the health and safety of the people and environment of Hawaii.
4. Include a review of regulations for impact on the health and safety of healthcare workers and the general public and environment.
The proposed changes may also include housekeeping amendments to the rules and amendments, deletions, or additions suggested by oral or written testimony.
All interested persons shall be afforded an opportunity to submit testimony orally or in writing at the time of the hearing. Any persons desiring to give written testimony are asked to submit two (2) copies of their testimony at the hearing, or before the hearing at the address below.
