NOTICE OF PUBLIC HEARING

“BOTTLE BILL” RULE CHANGES
TO PROVIDE COUNTING OF MORE CONTAINERS FOR REFUNDS

STATE OF HAWAII, DEPARTMENT OF HEALTH
SOLID AND HAZARDOUS WASTE BRANCH
(DOCKET NO. R-2-06)

Under Sections 91-3 and 342G-109, Hawaii Revised Statutes (“HRS”), the Department of Health (DOH) will hold a public hearing to consider proposed amendments to Chapter 11-282, Hawaii Administrative Rules (“HAR”), “Deposit Beverage Container Recycling.”

The amendment proposal increases the deposit beverage container load size that redemption centers are required to count on demand, from 49 to 200. This change will provide consumers with increased accuracy when redeeming deposit beverage containers.

A Public Hearing will be held on March 8, 2007 at 6:00 p.m. at the following locations through videoconferencing:

All interested persons are invited to testify on the proposed amendment orally or in writing at the hearing, or via written correspondence to the Department’s Solid and Hazardous Waste Branch (SHWB) at the address below, before the hearing. All written and oral submissions on the proposed rules shall be fully considered, but should be limited solely to the proposed amendment and not the benefits/disadvantages of the underlying program. We strongly encourage people to submit six (6) copies of their testimony to the Solid and Hazardous Waste Branch at the addresses below or send e-mail to lauren.willson@doh.hawaii.gov by 4:30 p.m., March 8, 2007.

The proposed rules may be reviewed in person for free at the SHWB and District Health Offices between 8:00 a.m. and 4:30 p.m., Monday through Friday, excluding holidays. The proposed rules may be viewed and downloaded for free from the Department’s website: http://www.hawaii.gov/health/about/rules/admrulechanges.html. Copies of the proposed rules may be bought at the SHWB office listed below for $1.10 or purchased by mail for $1.70. Please make checks payable to “State of Hawaii, Department of Health.”

The Department intends to decide on the proposed rules at the end of the hearing or as soon as practicable afterwards. If the Department does not make its decision immediately after the hearing and takes the testimony on the proposed rules under advisement, it will announce the date when it intends to make its decision.
