NOTICE OF PUBLIC HEARING
MAUI PLANNING COMMISSION

The Maui Planning Commission for the County of Maui hereby gives notice that it will conduct a hearing on November 28, 2006 commencing at 9:00 a.m., or as soon thereafter as is practicable in the Planning Department Conference Room, 1st Floor, Kalana Pakui Building, 250 S. High Street, Wailuku, Maui, Hawaii 96793 on the following:

SPECIAL MANAGEMENT AREA USE PERMIT

1. GREAT WHITE DEVELOPMENT requesting a Special Management Area Use Permit for a 2-story commercial building to contain six (6) offices and two (2) storage/ maintenance units comprising 4,960 square feet on 10,108 square feet of land with on-site parking, landscape planting, and related improvements at 2662 Wai Wai Place, Kihei Business Park, TMK: 3-9-051: 046, Kihei, Island of Maui.

COMMUNITY PLAN AMENDMENT, DISTRICT BOUNDARY AMENDMENT, CHANGE IN ZONING, AND SPECIAL MANAGEMENT AREA USE PERMIT

SAMUEL and JOHN GARCIA requesting a Community Plan Amendment from Hotel to Single-Family, a State Land Use District Boundary Amendment from State Agricultural District to State Urban District, a Change in Zoning from County Agricultural District to R-3 Residential District and a Special Management Area Use Permit for the proposed Garcia Family Subdivision, a 10-lot single family subdivision on approximately 5.947 acres of land adjacent to Makena-Keoneoio Road, TMK: 2-1-007: 067, Makena, Island of Maui. The subject public hearing will be conducted in accordance with the Hawaii Revised Statutes, the Maui County Code and the Rules of the Maui Planning Commission. Information pertaining to the subject applications may be obtained from the Maui County Planning Department, 250 S. High Street, Wailuku, Maui.

Petitions to intervene shall be in conformity with Section 12-201-20 of the Rules of Practice and Procedure for the Maui Planning Commission and shall be filed with the Commission and served upon the applicant no less than ten (10) days before the first public hearing date. Filing of all documents to the Commission is c/o the Maui Planning Department, 250 South High Street, Wailuku, Maui, Hawaii 96793. The deadline for the filing of a timely Petition to Intervene is November 13, 2006 at 4:30 p.m.

All testimony regarding the subject applications may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Department of Planning or may be presented at the time of the hearing.
