NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Liquor Commission of the City and County of Honolulu will hold a public hearing in the hearings room of the Liquor Commission, Pacific Park Plaza Building, 711 Kapiolani Boulevard, Suite 600, Honolulu, Hawaii, on Thursday, October 12, 2006, at 4:00 p.m., to consider the adoption of a rule pertaining to the direct shipment of wine by wineries, and the repeal of the existing rule pertaining to reciprocal shipments of wine, in the Rules of the Liquor Commission of the City and County of Honolulu (Proposed Amendment).
FURTHER NOTICE IS GIVEN that immediately following the taking of testimony at the October 12, 2006 public hearing, the Liquor Commission of the City and County of Honolulu will deliberate and conduct decision making on the Proposed Amendment.
The purpose of the Proposed Amendment is to comply with Act 227 (HB1968 HD1 SD1 CD1), Session Laws of Hawaii 2006, which was approved by the Governor on June 22, 2006 (Act 227). The specifics of the Proposed Amendment are summarized below:
Rule §3-82-33.5 Reciprocal Shipments of Wine. In accordance with Act 227, proposes the repeal of this Rule providing for direct shipments of wine to residents of the County of Honolulu from out-of-state wine manufacturers that afford Class 1 licensees an equal reciprocal shipping privilege.
Rule §3-82-[ ] Direct Shipment of Wine by Wineries. In accordance with Act 227, proposes the procedure whereby out-of-state wine manufacturers may obtain an annual permit to ship to residents twenty-one years of age and over in Honolulu County no more than six nine-liter cases of wine per household for personal use only and not for resale. Requirements include payment of a $48.00 permit fee, submission of a Hawaii Department of Taxation general excise tax license, and annual reporting of all shipments made to persons in Honolulu County.
Those persons wishing to testify at this hearing may register prior to the hearing at the hearing site and are encouraged to submit one copy of their testimony by hand delivery, fax, mail, or email.
Attendance at the public hearing is not a prerequisite for submission of testimony. Written testimony which is received by 4:30 p.m., Wednesday, October 11, 2006 at the below address will be included with the record of the hearing.
