NOTICE OF PUBLIC HEARING
Department of Agriculture
Proposed Administrative Rules for the
Aquaculture Development Special Fund

Pursuant to Chapter 91, Hawaii Revised Statutes (HRS), notice is hereby given that the Hawaii Department of Agriculture will hold public hearings to receive testimony on proposed administrative rules and fees for aquaculture services, chapter 4-11, Hawaii Administrative Rules (HAR), entitled “Aquaculture Development Special Fund.” Chapter 4-11, HAR, is being proposed to establish a schedule of fees for aquaculture services from the Aquaculture Development Program of the Department of Agriculture.

Chapter 4-11, HAR is being established to provide a fee schedule for recovery of a portion of the costs of providing diagnostic and disease management support to Hawaii’s emerging aquaculture industry, including fees for certain non-routine staff activities requested by out-of-state entities, for testing to render a diagnosis and recommend a treatment, and for issuing health certificates. Fees may be waived in a situation where payment would impose hardship. Briefly the fees are as follows:

A. Diagnostic Services

Microbiology $10.00 per isolate
Dot blot test $5.00 per test
Histochemistry $5.00 per test
PCR test $55.00 per vial
Histopathology $7.00 per slide
Necropsy $4.00 per slide
Water Quality $4.00 per sample

B. Health Certificates

Export $50.00 per certificate

C. Fee Non-Routine Services

Staff time $30.00 per hour

Additional fees may be charged for travel and transportation costs, staff time, and other direct expenses incurred by the program in collecting, analyzing and reporting information for a case.

All interested parties are urged to attend the hearings and submit testimony orally or in writing. Written testimony will be accepted until March 31, 2006 at the Department of Agriculture, 1428 South King Street, Honolulu, Hawaii 96814-2512 or via e-mail to HDOA.BOARD.TESTIMONY@HAWAII.GOV. Please include the word “testimony” and the subject matter when submitting written testimony. Those persons presenting oral testimony at the public hearing are asked to register prior to the convening of the hearing with staff.

Special accommodations, such as sign language interpretation, large printing, taped materials, accessible parking, can be provided if requested at least seven working days prior to the hearing. This request may be made in writing to the Aquaculture Development Program or by calling (808) 587-0030.
