WHEREAS, a Complaint to Quiet Title has been filed in the Circuit Court of the Third Circuit of the State of Hawai‘i as CIVIL NO. 07-1-0018K by the STATE OF HAWAI‘I BY ITS ATTORNEY GENERAL against defendants THE NATURE CONSERVANCY; YEE HOP, LIMITED; JOHN DOE 1-100; DOE PARTNERSHIPS 1-10; DOE CORPORATIONS 1-10; DOE TRUSTS 1-10; DOE ENTITIES 1-10; DOE ESTATES 1-10; THE SPOUSE(S), HEIR(S), ASSIGN(S), SUCCESSOR(S), PERSONAL REPRESENTATIVE(S), EXECUTOR(S), ADMINISTRATOR(S), GUARDIAN(S) AND/OR TRUSTEE(S) OF THE ABOVE-NAMED DEFENDANTS; ALL OTHER PERSONS UNKNOWN CLAIMING ANY RIGHT, TITLE, ESTATE, LIEN, ENCUMBRANCE OR INTEREST IN THE REAL PROPERTY DESCRIBED IN PLAINTIFF’S COMPLAINT; AND TO ALL WHOM IT MAY CONCERN, to quiet and confirm the State’s title in fee simple in the following described land, to wit:

PORTION OF THE GOVERNMENT LANDS OF ALIKA AND PAPA 1st

Alika and Papa 1st, South Kona Island of Hawai‘i, Hawai‘i

Beginning at a 1 1/4” pipe in Ahu at the southwest corner of this parcel of land and at the northeast corner of Grant 5045 to Joaquin Deniz, the coordinates of said point of beginning referred to Government Survey Triangulation Station “PUU NAHAHA” being 32,618.04 feet North and 31,235.32 feet East, thence running by azimuths measured clockwise from True South.

1. 256º 47’ 1260.29 feet along Kipahoehoe Natural Area Reserve,
Governor’s Executive Order 3165;

2. 317º 03’ 35” 7644.52 feet along Grant 2791 to C.C. Harris to a 1/2” pipe;

3. 351º 18’ 897.00 feet along Grant 2791 to C.C. Harris to a spike;

4. 79º 50’ 260.00 feet along Grant 3723 to J.M. Monsarrat to a 1/2” pipe;

5. 135º 38’ 27” 1781.57 feet along Grant 4914 to Franz Buchholtz to a “+” on
rock;

6. 79º 28’ 48” 79.93 feet along Grant 4914 to Franz Buchholtz;

7. 134º 57’ 7051.09 feet along Grant 6102 to R. von S. Domkowicz,
Grant 5092 to W.H.G. Arnemann and Grant 5045 to
Joaquin Deniz to the point of beginning and containing an
AREA OF 177.151 ACRES.

NOW THEREFORE, you are hereby cited to appear at the hearing of the above- entitled Complaint To Quiet Title in the Circuit Court of the Third Circuit, at Kealakekua, Hawai‘i, to be held in the courtroom the Honorable Elizabeth A. Strance at Keakealani Building (Old Kona Hospital), 79-1020 Haukapila Street, Kealakekua, Hawai‘i, 96750, on April 2, 2007, at 8:00 a.m. or as soon thereafter as the matter may be heard to show cause, if any of you have, why the prayer of said Complaint should not be granted. Unless you appear at said Court at the time and place aforesaid, your default will be recorded and the said Complaint will be taken as a confessed, and judgment by default will be taken against you for the relief demanded in the Complaint, and you will be forever barred from contesting said Complaint or any judgment entered thereon.
Appearance may also be entered by Answer or appropriate Motion filed in said proceeding prior to or at the time of said Hearing pursuant to rules of said Court.
