(AOAO Fairway Terrace vs. Salis)

AOAO Fairway Terrace (”Association”), as Lienholder, under and pursuant to Sections 514A-82(b)(13) and 667-5 through 667-10, HRS, as amended, gives notice that the Association will hold a sale by public auction on June 12, 2006 at 12:00 noon, at the Hamakua Lanai of the State Office Building, 75 Aupuni Street, Hilo, Hawaii 96720, of the real property located at 68-3831 Lua-Kula Street, Waikoloa, Hawaii 96738; being Apartment No. L-104 of the Fairway Terrace condominium (TMK No. (3) 6-8-003-002, CPR No. 0163; Apt. No. L-104). Terms of the sale are: (1) no upset price; (2) property sold strictly in an “as is” condition; (3) property sold without covenant or warranty, express or implied, as to title, possession or encumbrances and upon information and belief; property has encumbrances; (4) purchaser must pay 100% of the highest successful bid price in cash or by cashier’s or certified check at close of auction; (5) property is to be conveyed by the Association by a quitclaim conveyance to the successful purchaser, upon payment by purchaser of all costs related to the sale (deed preparation, conveyance tax, etc.) and all taxes and similar charges; (6) purchaser is responsible for securing possession at closing. THIS ACTION IS AN ATTEMPT TO COLLECT A DEBT, AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
