NOTICE OF PUBLIC HEARING

Pursuant to Sections 91-3 and 92-41, Hawaii Revised Statutes, notice is hereby given that the Hawaii Housing Finance and Development Corporation (HHFDC), Department of Business, Economic Development and Tourism (DBEDT), State of Hawaii, will hold a public hearing on April 30, 2007 at 10:30 a.m. to consider the adoption of Chapters 15-300 \u201DRules of Practice and Procedure,\u201D 15-302 \u201DRent-to-Own Program,\u201D 15-303 \u201DHawaii Rental Housing System Revenue Bond Program,\u201D 15-304 \u201DReal Property Lease Rent Renegotiations,\u201D and 15-305, \u201DLand Reform Program,\u201D Hawaii Administrative Rules (HAR), and the repeal of Chapters 17-2010 \u201DRent-to-Own Program,\u201D 17-2011 \u201DHawaii Rental Housing System Revenue Bond Program,\u201D 17-2015 \u201DReal Property Lease Rent Renegotiations,\u201D and 17-2016 \u201DLand Reform Program,\u201D HAR.

Act 196, Session Laws of Hawaii 2005, bifurcated the Housing and Community Development Corporation of Hawaii (HCDCH) into the Hawaii Public Housing Authority and the HHFDC, and provided that the HCDCH administrative rules shall remain in effect until amended by the appropriate new agency. Act 196 became effective on
July 1, 2006. Accordingly, the existing rules must be amended to reflect this transfer of responsibility.

The means by which this will be accomplished is to repeal the relevant HCDCH rule and repromulgate it under the HHFDC. The HHFDC is not substantively amending these rules except as follows: in proposed Chapter 15-300 \u201DRules of Practice and Procedure,\u201D the HHFDC is not adopting language currently found in section 17-2000-1(b), HAR, which states that the rules of practice and procedure do not cover evictions governed by chapter 17-2020, HAR. The HHFDC is not adopting this provision because it is only applicable to evictions from federal public housing administered by the Hawaii Public Housing Authority.

All interested persons are invited to attend the hearing and state their views relative to the proposed rule either orally or in writing. Should written testimony be presented, five copies shall be made available to the presiding officer at the public hearing or within seven days before the hearing to:

Copies of the proposed rules are available for review at the HHFDC administrative office located at 677 Queen Street, Suite 300 during regular business days and hours between 7:45 a.m. and 4:30 p.m. Copies are also available on the HHFDC web site at http://www.hawaii.gov/dbedt/hhfdc and regional public libraries. Copies of the proposed rules may also be mailed to any interested person upon advance payment of the following copying and postage costs:
