NOTICE IS HEREBY GIVEN of a Special Meeting to be held by the Board of Appeals of the County of Hawai’i in accordance with the provisions of Section 6-9.2 of the Charter of the County of Hawai’i and Rule 1-5 of the Board’s Rules of Practice and Procedure.

Notice is hereby given that pursuant to Hawai’i Revised Statutes Section 92-3.5, the Board of Appeals will be conducting this meeting via videoconference. If the audio stream between Kona and Hilo is lost for more than a short period of time, the meeting will be terminated.
Board Chair Dean Au and Board Member Frank Commendador will attend this meeting at the County of Hawai’i Planning Department Conference Room, 101 Aupuni Street, Suite 3, Hilo, Hawai’i 96720. Board Members Mark Travalino and Kelly Ann Valenzuela will attend this meeting at the West Hawai’i Civic Center, Planning Department Conference Room, 74-5044 Ane Keohokalole Highway, Kailua-Kona, Hawai’i 96740.
The public can attend this meeting and testify at either location indicated above.

OLD BUSINESS
The Hawai’i Intermediate Court of Appeals issued its decision in the Missler case (# CAAP-13-0002347) on June 26, 2017. The Board will discuss what further action, if any, it may take regarding this case.
EXECUTIVE SESSION
The Board of Appeals anticipates convening an executive meeting regarding the Missler case listed above pursuant to Hawai’i Revised Statutes 92-5(a)(4), for the purpose of consulting with the Board’s attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities. A 2/3 vote of the members present is necessary to hold an executive meeting pursuant to Hawai’i Revised Statutes 92-4 and Rule 1-5 (e) of the Board’s Rules of Practice and Procedure.
