NOTICE OF REPEAL OF ADMINISTRATIVE RULE
The University of Hawaii, pursuant to Hawaii Revised Statutes Chapter 91, subsection 91-3(f), hereby gives thirty days’ public notice that it intends to repeal Title 20, Chapter 20 of the Hawaii Administrative Rules entitled “Protection of Educational Rights and Privacy of Students” (for convenience referred to as “Chapter 20-20”). The proposed effective date of the repeal shall be June 14, 2017, or as soon thereafter as certified copies of the repeal have been filed with the Office of the Lieutenant Governor.
Chapter 20-20 provides procedures for the protection of students’ rights to privacy related to the education records of the students, in accordance with the requirements of the Family Educational Rights and Privacy Act (“FERPA”) and the federal regulations adopted by the U.S. Department of Education to implement FERPA. This chapter is not required by law and is unnecessary given that the University has a policy governing such privacy protection. AP 7.022, available at http://www.hawaii.edu/policy/index.php? action=viewPolicy&policySection=ap&policyChapter=7&policyNumber=022&menuView=closed, establishes uniform procedures governing a student’s access to the student’s own education records, and access to student education records by the public, University officials, other governmental agencies that comply with FERPA, and other parties. If Chapter 20-20 is repealed, AP 7.022 will be amended to remove references to Chapter 20-20.

Any interested person may petition the University Board of Regents regarding the proposed repeal of Chapter 20-20 by submitting a petition to the Board pursuant to Section 91-6, Hawaii Revised Statutes, at 2444 Dole Street, Bachman 209, Honolulu, Hawaii 96822, no later than May 31, 2017.
