NOTICE OF FINDING OF NO SIGNIFICANT IMPACT
AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Hawaii Island Community Development Corporation, a Hawaii non-profit.
REQUEST FOR RELEASE OF FUNDS
On or about November 21, 2016, the County of Hawaii’s Office of Housing and Community Development will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of $700,000.00 of 2015 and $455,429.00 of 2016 Community Development Block Grant (CDBG) program funds under Title 1 of the Housing and Community Development Act of 1974, as amended, for a total of $1,155,429.00 of CDBG funds to undertake a project known as the Hilo Adult Day Care Center Project. The project involves the construction of a new 8,000 square foot single story structure to house the Hilo Adult Day Center which provides adult day care for elders and adults who are frail, physically and /or mentally challenged. The proposed project is located at TMK: (3) 2-4-001:185 on the northwest corner of Mohouli and Komohana Street within the Mohouli Heights Senior Neighborhood Project. The total project cost is estimated at approximately $7,900,000.
FINDING OF NO SIGNIFICANT IMPACT
The County of Hawaii has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the County of Hawaii’s Office of Housing and Community Development, 50 Wailuku Drive, Hilo Hawaii 96720 and may be examined or copied weekdays 7:45 a.m. to 4:30 p.m. except holidays.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the County of Hawaii, Office of Housing and Community Development, 50 Wailuku Drive, Hilo Hawaii 96720. All comments must be received by November 9, 2016 and will be considered by the County of Hawaii prior to the submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The County of Hawaii certifies to HUD that William P. Kenoi, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the County of Hawaii and the Hawaii Island Community Development Corporation to use program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will consider objections to its release of funds and the County of Hawaii’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on the following bases: (a) the certification was not executed by the Certifying Officer of the County of Hawaii; (b) the County of Hawaii has omitted a step or failed to make a determination or finding required by HUD regulations at 24 CFR part 58 or by CEQ regulations at 40 CFR 1500-1508, as applicable; (c) the County of Hawaii has omitted one or more steps in the preparation, completion or publication of the Environmental Assessment or Environmental Impact Study per 24 CFR Subparts E, F or G of Part 58, as applicable; (d) the grant recipient or other participant in the development process has committed funds for or undertaken activities not authorized by 24 CFR Part 58 before release of funds and approval of the environmental certification; (e) an other Federal, State or local agency has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Mark A. Potential objectors should contact HUD at (808) 457-4678 to verify the actual last day of the objection period.
