(By: Recktenwald, C.J., Nakayama, McKenna, Pollack, and Wilson, JJ.)
Upon due consideration of the entire record in Disciplinary Board of the Hawai`i Supreme Court v. Sheila S.H. Sue-Noguchi, including statements made by Respondent Sue-Noguchi before the Disciplinary Board, documents submitted by her to the Board and subsequently made part of the record in this matter before this court, and the affidavit and materials submitted to this court on August 8, 2016 by the Office of Disciplinary Counsel, we find and conclude, pursuant to Rule 2.19(b) of the Rules of the Supreme Court of the State of Hawai`i (RSCH), that Respondent Sue-Noguchi is incapable of practicing law or defending herself in the disciplinary proceedings currently held in abeyance by this court’s February 9, 2016 order.
