Upon due consideration of the entire record in Disciplinary Board of the Hawai`i Supreme Court v. Sheila S.H. Sue-Noguchi, including statements made by Respondent Sue-Noguchi before the Disciplinary Board, documents submitted by her to the Board and subsequently made part of the record in this matter before this court, and the affidavit and materials submitted to this court on August 8, 2016 by the Office of Disciplinary Counsel, we find and conclude, pursuant to Rule 2.19(b) of the Rules of the Supreme Court of the State of Hawai`i (RSCH), that Respondent Sue-Noguchi is incapable of practicing law or defending herself in the disciplinary proceedings currently held in abeyance by this court’s February 9, 2016 order. Therefore,
IT IS HEREBY ORDERED that Respondent Sue-Noguchi’s interim involuntary inactive status is amended to become final, effective with the filing of this order. Respondent Sue-Noguchi shall remain on involuntary inactive status until she successfully petitions this court, at her discretion, for reinstatement, pursuant to the process set forth in RSCH Rule 2.19(f).
IT IS FURTHER ORDERED that the Office of Disciplinary Counsel shall continue to suspend and hold in abeyance the investigation of complaints and the disciplinary proceedings to the extent required by RSCH Rule 2.19(h).
IT IS FINALLY ORDERED that the Board shall publicize notice of Respondent Sue-Noguchi’s final transfer to inactive status, as required by RSCH Rules 2.19(d) and (e).
