NOTICE OF PROPOSED MODIFICATION OF
WATER POLLUTION CONTROL PERMIT

July 21, 2016

The Department of Health (DOH) proposes to modify the following National Pollutant Discharge Elimination System (NPDES) permit to discharge to receiving
State waters:

CCH, Kailua Regional Wastewater Treatment Plant, HI 0021296

This permit is being modified under allowance by Hawaii Administrative Rules
(HAR), Section 11-55-16 and Title 40 Code of Federal Regulations (40 CFR), Part 122.62(a); (2) the Director received new information; and (15) to correct technical mistakes in calculations, or mistaken interpretations of law.

City and County of Honolulu, Kailua Regional Treatment Plant (HI 0020877) major modification includes: 1) adding a permit reopener condition that allows for the revision of mass-based effluent limitations for biochemical oxygen demand (BOD) and total suspended solids (TSS) should an acceptable antidegradation analysis be submitted; 2) adding a permit reopener condition that allows for the revision of effluent limitations for enterococcus, chlordane and dieldrin should an acceptable dilution study be submitted; and 3) removing Part I.5 of the permit for consistency with 40 CFR Section 122.41(l). This major permit modification is authorized under HAR, Section 11-55-16 and 40 CFR Section 122.62(a)(2) for revisions 1) and 2); and 40 CFR Section 122.62(a)(15) for revision 3) listed above. The expiration date of the modified permit shall remain as February 13, 2019.

In accordance with 40 CFR Sections 124.5(c)(2) and 122.62, only the conditions outlined above shall be reopened. All other conditions shall remain in effect for the duration of the permit. Please note that you may only comment or request a public hearing on the modified/reopened items described above.

Persons wishing to comment upon or object to the proposed modified NPDES permit or to request a public hearing, should submit their comments or requests in writing no later than 30 calendar days after the date of this notice, either in person or by mail, to:

All comments and requests received on time will be considered. If DOH determines that there is significant public interest, a public hearing may be held after at least 30 calendar days of public notice.

If DOH’s position is substantially unchanged after considering all timely written comments and all oral comments at any public hearing that may be held, then the DOH will issue the modified NPDES permit and this action will be final.
