A REQUEST FOR AMENDMENTS TO CHAPTER 21, REVISED ORDINANCES OF HONOLULU 1990, AS AMENDED (“THE LAND USE ORDINANCE”), RELATING TO MISCELLANEOUS “HOUSEKEEPING” MEASURES

The Department of Planning and Permitting (DPP) is proposing to revise Bill 79 (2015), relating to miscellaneous “housekeeping” measures. In a memo dated October 2, 2015, DPP submitted to the Planning Commission for consideration and appropriate action, a request to amend Chapter 21, Revised Ordinances of Honolulu. This is an additional adjustment, which is a minor change to Land Use Ordinance (LUO) Section 21-2.140-1, Specific Circumstance. DPP overlooked this situation in the original proposal and now wants to include language in the LUO that would address another situation when an ohana dwelling unit is nonconforming but the current regulations will not allow it to be rebuilt or expanded.

Section 21-2.140-1(i)(1) is amended by adding subsection (D), to read as follows:

(D) The ohana dwelling was legally established but is no longer allowed pursuant to Sections 21-8.20(c)(2) and (3).

Written testimony (15 copies) may be filed with the Planning Commission at least two (2) business days before the date and time of the hearing. Attendance at the public hearing is not necessary to submit written testimony.
