RULE 9 OF THE
COUNTY OF HAWAI’I PLANNING DEPARTMENT RULES
AND RELATED PUBLIC HEARING

NOTICE IS HEREBY GIVEN of a proposed amendment to Rule 9 of the County of Hawai’i Planning Department Rules and of public hearing for the proposed amendment, which is initiated by the County of Hawai’i Planning Director, pursuant to the County of Hawai’i Planning Department Rule 2 and Article 1, Section 25-1-4 of the Hawai’i County Code.

The Planning Director is initiating an amendment to Rule 9 of the County of Hawai’i Planning Department Rules to include the departmental procedures for enforcement of the Special Management Area (SMA). The proposed amendment incorporates appropriate Hawai’i County Code and Hawai’i Revised Statutes references as well as several non-substantive housekeeping edits.

The purpose of the public hearing is to afford all interested persons a reasonable opportunity to provide comments on the proposed amendment. Written comments may be submitted in person at the public hearing or be submitted to the Planning Department no later than January 5, 2016. A copy of the proposed amendment is on file and available for inspection during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai’i 96720, and at the
West Hawai’i office of the Planning Department, West Hawai’i Civic Center,
74-5044 Ane Keohokalole Highway, Kailua-Kona, Hawai’i 96740. In addition, the proposed amendment may be viewed at the Planning Department’s website (www.cohplanningdept.com).

Any person requiring special assistance or auxiliary aid and/or services to participate in the hearing should contact the Planning Department at 961-8288 three (3) working days prior to the hearing so that appropriate arrangements can be made.

Notice to Lobbyists: If you are a lobbyist, you must register with the Hawai’i County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawai’i County Code}. A lobbyist means “any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials.” {Article 15, Section 2-91.3(a)(6), Hawai’i County Code} Registration forms and expenditure report documents are available at the Office of the County Clerk,
