PUBLIC NOTICE

The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and E.M. Rivera and Sons, Inc. The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 12-CA-EO-25, alleging that E.M. Rivera and Sons, Inc. violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, and the Temporary Covered Source Permit (CSP) No. 0603-01-CT, by late reporting of annual emissions, semi-annual monitoring reports, compliance certification and annual fee payment.

Subsequent to the issuance of NOVO Docket No. 12-CA-EO-25, the DOH alleged various reporting and annual fee violations on Temporary Noncovered Source Permit No. 0554-01-NT.

A Consent Order (CO) has been drafted that proposes to settle this case. The proposed CO and NOVO is available for public review during regular office hours, Monday through Friday, 7:45 a.m. to 4:15 p.m., at the following location:
