NOTICE OF PUBLIC HEARING AND CONTESTED CASE HEARING

YOU ARE HEREBY NOTIFIED that HPBS, INC. (“Petitioner”) filed a Petition for Review and Approval of Central Scheduling System (CSS) Charge Increase and Revised CSS Schedule (“Petition”) with the Department of Commerce and Consumer Affairs, State of Hawaii (“DCCA”).
YOU ARE ALSO NOTIFIED that pursuant to Hawai’i Revised Statutes (“HRS”) Chapters 91 and 462A, and Hawai’i Administrative Rules Chapter 96, a public hearing in this matter has been scheduled for:

Petitioner has proposed the following changes, to be effective as of January 1, 2016, to the current rates that were approved by the Director’s Final Order filed December 28, 2012, in the case of In the Matter of the Petition for Change of Pilotage Rates of the Hawaii Pilots Association, PTP 2012-1, , as follows:

1. CSS Charge: In addition to the base fees, a charge to fund the operation of the Central Scheduling System (CSS) shall be assessed for all vessel movements. This CSS charge shall be $439.80 for Honolulu Harbor and $732.99 for Kalaeloa and Neighbor Island ports starting on January 1, 2016. On January 1, 2017, the CSS charges will increase by nine and one half per cent (9.5%) from the amounts that are in effect on December 31, 2016.

Interested persons may submit data, views, or arguments in favor or against the proposed changes either orally or in writing at the public hearing, or written comments may be filed with the Director of the Department of Commerce and Consumer Affairs (“DCCA”) until September 10, 2015. Documents may be filed at the Office of Administrative Hearings, DCCA, 335 Merchant Street, Suite 100, Honolulu, Hawai’i 96813 (telephone 586-2828). Copies of the Petition are available at the Office of Administrative Hearings.
YOU ARE FURTHER NOTIFIED that a contested case hearing on the Petition will be convened on October 2, 2015, at 9:00 a.m. in a hearings room at the Department of Commerce and Consumer Affairs, 335 Merchant Street, Honolulu, Hawai’i 96813 and a pre-hearing conference has been scheduled for September 17, 2015, at 9:00 a.m. Please check the posting outside of Suite 100 for hearing room assignments on the day of the scheduled proceeding. The deadline to intervene in the contested case hearing is 4:00 p.m. on September 13, 2015.
