PUBLIC NOTICE
The Department of Health, State of Hawaii (DOH), is notifying all interested persons of the proposed settlement between the DOH and Alii Dry Cleaners. The DOH issued a Notice and Finding of Violation and Order (NOVO) in Docket No. 13-CA-EO-07, alleging that Alii Dry Cleaners violated state air pollution laws, Hawaii Revised Statues §342B-11, Hawaii Administrative Rules §11-60.1-2, and the following conditions of the Noncovered Source General Permit No.0093-01-NG:
1) Attachment I, Standard Condition 24: Failed to submit an application for permit renewal a minimum of sixty (60) days prior to the permit expiration date. The application was submitted late on May 13, 2013, seventy-two (72) days after the due date of March 2, 2013;and
2) Attachment III: Failed to submit the annual fee of five hundred dollar and no cent ($500.00) for the 2012 calendar year within sixty (60) days after the end of the calendar year.

May 13, 2013, seventy-three (73) days after the due date of March 1, 2013.
A Consent Order (CO) has been drafted that proposes to settle this case. The proposed CO and NOVO is available for public review during regular office hours, Monday through Friday, 7:45 a.m. to 4:15 p.m., at the following location:
